RESOLUTION NO. 40-03
WHEREAS, the boundaries of Jefferson County Fire Protection District No.3 were established
by Resolution No. C-621 dated October 18, 1965; and,
WHEREAS, the Board of Fire Commissioners of Jefferson County Fire Protection District NO.3
have, by adoption of a Resolution No. 2003-01, requested that the boundaries of said Fire District be amended
to include the unprotected lands contiguous to the current fire district boundaries, but not originally included
within the Fire District upon its' establishment; and,
WHEREAS, after review of the request submitted by the Fire District #3 Commissioners, State
and County regulations, the following findings are made:
1, The annexation of these unprotected properties into the Fire Protection District is in the public interest
and conducive to the public safety, welfare, and convenience of the people who live, work and recreate
in this area.
2. A petition signed by over 60% of the qualified registered electors residing within the territory proposed
to be annexed was found to be sufficient by the County Auditor
3. The Board of Fire Commissioners of Fire Protection District #3 concur with the proposed annexation.
4. In accordance with RCW 52.04.011 the Board of County Commissioners held a hearing on the petition
on July 21, 2003 and no public comments against the proposed annexation were received.
NOW, THEREFORE, BE IT RESOL VED, by the Board of County Commissioners of Jefferson
County, that the request of the Board of Commissioners of Fire Protection District #3 is approved.
BE IT FURTHER RESOL VED, that the attached Exhibit A which includes the legal description
of the area to be annexed and a map of the new boundaries of Fire Protection District NO.3 are hereby
adopted,

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that a public hearing is scheduled by the Jefferson County
Board of Commissioner for MONDAY. Julv 21.2003 at 10:15 a.m, in the Commissioners'
Chamber, County Courthouse, 1820 Jefferson Street, Port Townsend, W A 98368.
This public hearing has been scheduled for the Commissioners to take comments for or against a
petition for annexation of contiguous unprotected land into the boundaries of Fire Protection
District No.3. The lands to be annexed are described as all of Sections 23 and 26, Township 28
North, Range 1 West, W.M. situated in Jefferson County, Washington.

UNPROTECTED LAND INTO
FIRE PROTECTION DISTRICT NO.3
I HEREBY CERTIFY that this office has checked the attached Petition for
the annexation of unprotected land into Rre Protection District No. 3 as defined in
the area on the attached map and legal description.
Said Petition contained a total of one signature. There is one valid signature
from the proposed area to be annexed and constitutes 100% of the land ownership
in the proposed unprotected land to be annexed.
Pursuant to RCW 52.04.031 the petition for annexation must be signed by
not less than sixty percent (60%) of the landowners in the proposed area to be
annexed. This petition meets the requirement of having no less than one valid
signature from landowners in the proposed area and is now certified as being
SUFFICIENT.

Annexation to a Fire District via the "petition" method.
Does annexation of uninhabited land to an existing Fire District require a public hearing
before the County legislative authority, i.e., the County Commisioners?
Yes, pursuant to the route one has to take through the applicable state laws.
One has to look at the following statutes in the following order
·
RCW 52.04.031 details the petition method and states that owners of 60% of the land to be
annexed must agree to the annexation and petition the Fire District Commissioners for
annexation; next is
·
RCW 52.04.041 detailing the obligation of the Fire District Commissioners to have a public
hearing; next is
·
RCW 52.04.051 detailing that the Fire Commissioners then decide whether to annex the
area proposed for annexation in the petition and if they do annex, then they file their resolution
accepting annexation with the County Commissioners. but RCW 52.04.051 adds this kicker:
"[t]he proposed annexation shall be subject to action by the county legislative authority, as
provided under RCW 52.04.011, to the same extent as if the annexation were done under the
election method of annexation," meaning

RCW 52.04.011 applies, which in turn states that the County Auditor has to certify the
petition and that despite use of the petition method all of the rules applicable to the election
method apply, which, in turn, mandates that

RCW 52.02.040(1) applies and that RCW mandates a public hearing before the elected
County Commissioners, but why would there be two hearings? The statute seems to think
there are and so does the County Assessor.
Since it seems to be the safe way to go, why not have another public hearing in front of the
County Commissioners.

A RESOLUTION FOR ANNEXATION OF UNPROTECTED LAND INTO THE FIRE
DISTRICT BY PETITION METHOD - POPE RESOURCES, PETITIONER
WHEREAS, The Board of Commissioners of Jefferson County Fire Protection District No.
3 was presented with a Petition for Annexation of Unprotected Land into Fire Protection
District No.3, signed by Pope Resources, representing 100% of the registered land
owners included in the following legal description;
AN1}'WHEREAS, the registered owner who signed the petition to annex believes that it
would be conducive to the public safety, welfare and peace of mind to be included in the
fire district;
AND WHEREAS, the area is currently located in no fire protection district and is
contiguous to Jefferson County Fire Protection District No.3 boundaries;
AND WHEREAS, the Board of Commissioners of Jefferson County Fire Protection District
NO.3 has conducted a Public Hearing in accordance with RCW 52.04, Annexation by
Petition, prior to adoption of this Resolution.
NOW THEREFORE BE IT RESOLVED, that the Board of Commissioners of Jefferson
County Fire Protection District No.3 does hereby adopt this Resolution acceptiRg the
Petition of Annexation set forth in the following legal description and plat of the
boundaries of the area to be annexed, specifically Sections 23 & 26 Township 28
No., Range 1 West W.M.; at the June 10, 2003, Regular Meeting of this Co ission.
