RESOLUTION NO. 83-02
WHEREAS, Jefferson County is applying to the State Office of Community
Development for funding assistance; and,
WHEREAS, it is necessary that certain conditions be met as part of the
application; and,
WHEREAS, David Goldsmith, County Administrator, is authorized to submit this
application to the State of Washington, on behalf of Jefferson County; and,
NOW, THEREFORE, BE IT RESOL VED, that the Board of Jefferson County
Commissioners authorizes submission of this application to the State Office of Community
Development to request $127,646.00 to fund public service activities in coordination with the
Olympic Community Action Agency, and certifies that, if funded, it:
~ Will comply with applciable provisions of Title I of the Housing and Community
Development Act of 1974, as amended and other applicable State and federal laws;
~ Has provided opportunities for citizen participation comparable to the State's
requirements (those described in Section 104(a)(2)(3) of the Housing and Community
Development Act of 1974, as amended); has complied with all public hearing
requirements and provided citizens, especially low- and moderate-income persons, with
reasonable advance notice of, and the opportunity to present their views during the
assessment of community development and housing needs, during the review of available
funding and eligible activities, and on the proposed activities;
~ Has provided technical assistance to citizens and groups representative of low- and
moderate-income persons that request assistance in developing proposals;
~ Will provide opportunities for citizens to review and comment on proposed changes in
the funded project and program performance;
~ Will not use assessments against properties owned and occupied by low- and moderate-
income persons or charge user fees to recover the capital costs of CDBG-funded public
improvements from low- and moderate-income owner-occupants;
~ Will establish a plan to minimize displacement as a result of activities assisted with
CDBG funds; and assist persons actually displaced as a result of such activities, as
provided in the Uniform Relocation Assistance and Real Property Acquisition Policies
Act of 1970, as amended;
~ Will conduct and administer its program in conformance with Title VI of the Civil Rights
Act of 1964 and the Fair Housing Act, and will affirmatively further fair housing, (Title
VIII of the Civil Rights Act of 1968); and
RESOLUTION NO. 83-02 re: Certification of Compliance for CDBG Public Services Grant
þo Has adopted and enforce a policy prohibiting the use of excessive force by law
enforcement agencies within its jurisdiction against any individuals engaged in
nonviolent civil rights demonstrations; and has adopted and implemented a policy of
enforcing applicable State and local laws against physically barring entrance to or exit
from a facility or location which is the subject of such nonviolent civil rights
demonstrations within its jurisdiction, in accordance with Section 1 04( 1) of the Title I of
the Housing and Community Development Act of 1974, as amended; and
ÞO Will provide, upon request, and prior to any obligation of funds being made, a complete
and accurate CDBG Federal Funds Disclosure Report detailing the required
applicant/grantee information, and as appropriate other government assistance provided
or applied for, interested parties and expected sources, and uses of funds.
BE IT FINALLY RESOLVED, that the Board of Jefferson County Commissioners,
designates the County Administrator, as the authorized Chief Administrative Official and
authorized representative to act in all official matters in connect with this application and
Jefferson County's participation in the Washington State CDBG Program.

GENERAL APPLICATION INFORMATION
This application handbook provides all the necessary forms and instructions to apply for a 2003
Community Development Block Grant (CDBG) Public Services Grant. The completion of the
application forms and federal requirements must be coordinated between the county and the
community action agency,

RECENT CHANGES TO THE 2003 APPLICATION
· On page 2 the application now specifically acknowledges the community action agency's
role in providing beneficiary data for the CDBG 2003 contract with its submission of the
Community Service Block Grant (CSBG) application's Form 5: Annual Projections of
Outcome Measures to the CSBG Program.
· The requirements for ensuring appropriate outreach to non-English speaking residents
within the service area have been revised and are explained in the Citizen Participation
Requirements section, page 19. A new form to document the county's and community
action agency's outreach and accommodation efforts is to be submitted with the CDBG
application.
· To further meet the intent of the citizen participation requirements, the county and
community action agency are strongly encouraged to review the community action agency's
Community Needs Assessment and to inform partner organizations of the proposed use of
CD8G Public Service Grant funds and the application's public hearing. See page 21 for
further information.

GENERAL APPLICATION INFORMATION
ELIGIBLE ACTIVITIES AND SERVICE CATEGORY BUDGET DETAIL
The Index of CSBG and CDBG Service Categories lists the eligible CDBG service categories.
A complete listing of eligible activities can be found in Section 105 (a) of Title I of the Housing
and Community Development Act of 1974, as amended through 1994, and 24 CFR 570,201 (e).
CDBG work programs are developed, the following issues should be considered:
CDBG funds can only finance CDBG eligible service categories.
Accountability is easier if CDBG funds are distributed between fewer categories,
The CDBG Program will accept the administrative and direct costs identified in
the CAA's Cost Allocation Plan, as defined by the CSBG Policy and Procedures
Manual. The CM's total CSBG and CDBG administrative costs cannot exceed
15 percent of the contractor's total budget (all funding sources).
INELIGIBLE ACTIVITIES
CDBG Public Services Grants may not be used to fund:
· Political activities
· Payments to individuals for their food, clothing, utilities, or other income
payments
· Capital costs
Housing rehabilitation (including weatherization activities)
OUTCOME and BENEFICIARY DATA
The CDBG Program will coordinate with the Community Services Block Grant (CSBG) Program
to determine the anticipated number of beneficiaries for the 2003 CDBG contract by using the
data already provided in the community action agency's CSBG Application, Form 5: Annual
Projections of Outcome Measures,
RELATIONSHIP BETWEEN PUBLIC SERVICE GRANT AND OTHER CDBG FUNDS
It is possible for an eligible jurisdiction to apply for more than one type of CDBG funding within
the same program year. A Resolution with Certifications of Compliance, Disclosure Report and
the county's public hearing must be specific to each application.

Please read the entire application handbook before preparing your application. The application
must include the completed application forms and federal requirements. The application is due
by December 13, 2002. Submit one original, signed in ink, and one copy to:

You will use this index in the preparation of your two-year CSBG Community Action Plan/Application
and your one-year CDBG Public Service Grant Application.
100 EMPLOYMENT
100.1 Job PreDaration. Placement & Development
Job Preparation, Placement, Development and Retention Programs are defined as an activity to
assist low-income people to secure and maintain meaningful employment. This includes
information about employment and job training services; referral to employment; periodic
counseling of un - or under- employed, ex-offenders and women-heads-of-household; assistance
with job hunting skills; job placement and skills training. .
Outcome Measures

Seeking employment who obtained it.

200.1 Educational Assistance
Education Assistance is defined as an activity to assist low-income people to obtain an adequate
education. This includes: primary, secondary and adult basic education; English as a Second
Language (ESL) and citizenship classes; infonnation about educational opportunities and
referral to educational services, counseling and guidance, diagnostic assessment for educational
aspirations, skills and opportunities for youngsters seeking scholarships to college or technical
school, and direct educational instruction and testing.

Obtaining measurable gains in job readiness.

Adult and Child Care is defined as a program and activity to provide day and/or evening, part

300 MONEY MANAGEMENT
300.1 Monev Manaeement
Money Management is defined as an activity to assist low-income people to make better use of
available income. This includes information about how to better manage finances; referral to
agencies that provide financial management classes; and counseling and instructing low-income
individuals and families in preparing and implementing household budgets and personal credit.
Also includes conservation education and general consumer education and assisting low-
income individuals and families to prepare their federal, state, and/or local annual income tax
reports.
Outcome Measures

Believe they use income more efficient and effectively.

400 HOUSING
400.1 Permanent Housine Assistance
Permanent Housing Assistance is defined as housing counseling regarding long- and short-term
rental or mortgage assistance; eviction prevention; first month's rent financial assistance; loan
assistance for home buying; rent/interest subsidies and development of housing; cooperatives;
and single and multi-family dwellings and special groups housing (senior housing, Native
American housing, veteran housing, college housing, etc,).

Believe they can solve housing problems with counseling.
Obtained permanent housing.

400.2 Transitional Housine:
Transitional Housing is defined as housing resources for individuals and families who need

supportive services in order to develop the life skills necessary to obtain and maintain
pem1anent housing. Usually 6 to 24 months in duration. Services may include: counseling,
employment, education, household management, personal planning and other services designed
to stabilize the family as they seek permanent housing.

400.3 Emen!encv Shelter Services
Emergency Shelter Services is defined as sheltering of individuals and families during periods
of dislocation or emergency, This includes providing the required physical care including
temporary housing in a shelter, motel, or transitional housing program; food; necessary medical
and clothing needs; and planning for more permanent solutions to the problem, including
contact with community resources for housing and employment in the case of transients.

400.4 Minor Home Improvements and Rehabilitation
Minor Home Improvements and Rehabilitation is defined as an activity to improve, rehabilitate
and repair housing essential for safety, and removing health hazards to the individuaJ, family or
the community, Under this program, financial assistance or direct help is given in making
improvements and/or repairs including repairs to the foundation, roof or basic structure, as well
as water and waste disposal systems. (CSBG prOf!ram funds mav be used for this activity
onlv after obtaining: a waiver,)
Note: CDBG Public Service Grant funds may not be used for housing rehabilitation.

400.5 Housing: Purchase or Construction Services
Housing Purchase or Construction Services is defined as an activity to build or purchase
housing including providing far design, financing, construction, preparation of infrastructure,
permits and placement of residents. (CSBG prog:ram funds mav be used for this activity
onlv after obtainin2 a waiver.)

400.6 Weatherization Services
Weatherization Services is defined as activities which install energy efficiency measures in
low-income households. The primary objective of the program is to make home energy more
affordable by reducing energy consumption needs. Weatherization also helps preserve homes.
This may include diagnostically directed air sealing; attic, wall and floor insulation, and heating
system efficiencies; energy conservation education for household members; and measures to
mitigate health and safety hazards such as carbon monoxide poisoning and other air quality
dangers.

Unduplicated number of housing units weatherized in a year.

500 EMERGENCY ASSISTANCE
500.1 Emer!!encv and Crisis assistance
Emergency and Crisis Assistance is defined as an activity which responds to household
emergencies and disasters with direct relief and referrals to existing community programs,
including one-time payments or short-tenn loans to families or individuals; legal assistance;
shelter; clothing; intervention in emergencies resulting from child, spouse, alcohol or drug
abuse; emergency medical and/or dental services, and/or cash support.

Who have more resources to meet basic needs.
In crisis whose emergency needs were ameliorated.

Note: CDBG funds may not be used for payments of rent, mortgages or energy assistance.
600 NUTRITION
600.1 Food and Nutrition
Food and Nutrition is defined as an activity designed to counteract conditions of starvation and

malnutrition. Programs include information about nutrition services and referral to community
programs; counseling to individuals or groups about nutrition, diet, and food preparation;
distribution of surplus commodities, donated food-stuffs, and produce; preparation and service
of hot breakfasts, lunches, or dinners including congregate or home-delivered meals; gleaning;
community gardens; and cmmeries.

700 LINKAGES
700.1 Information and Referral
Information and Referral is defined as a direct service activity to lillie low-income people with
other human resources in the community, and/or an activity by an agency to link other resources

700.2 Transportation Services
Transportation Services is defined as an activity that conveys participants, young and old, to
services they need within their communities, These services include transportation to meet the
various needs to support independent living and responds to the special transportation needs of
selected groups of individuals, who, for some reason, are not able or are not in a position to
utilize normal means of transportation or cannot afford to pay for transportation.

700.3 Communitv Oreanizine and Development
Community Organizing and Development is defined as an activity designed to establish
linkages between individuals, community action agencies, governmental and other social
services programs for the purpose of organizing, improving, revitalizing and informing the
community. Key elements may include, but are not limited to, planning and designing

programs and services; collaboration with other service providers and community organizations
(including faith based organizations); organizing a wide range of resources to focus on
community problems having a measurable and potentially major impact on causes and
symptoms of poverty in the community or those areas of the community where poverty is a
particularly acute problem; conducting ongoing needs assessments; economic development
projects; and participation in national, state and local enterprises addressing a broad range of
services needed by low-income groups.

Citizen Participation Requirements
For CDSG Public Service Grants
To apply for CDBG funds, a jurisdiction must show it has involved its citizens in the
CDBG application process and complied with the specific federal citizen participation
requirements outlined in 24 CFR 570.486, These regulations are provided in the
sample handout on page 27. The purpose of these citizen participation activities is to
inform the residents, local organizations that serve low-income persons and the county
decision-makers of the availability of CDBG funds and to provide them the opportunity
to present potential projects and input on proposed projects.
If a jurisdiction intends to apply for more than one type of CDBG grant during the same
year, it is advisable to contact the CDBG office to discuss how to coordinate these
citizen participation and public hearing requirements.
Also, the 2002 Public Service Grant contracts are approaching their end, A public
hearing that reviews the county's and community action agency's performance and use
of CDBG funds is required as part of this contract's close-out process, It is advisable to
combine the public hearing requirements for the 2003 application and the 2002 close-
out process into one public hearing. This can be accomplished by following the sample
public hearing notice language, provided on page 25,

SUMMARY
The minimum citizen participation requirements for the submission of a COSG
application are:
1. Conduct at least one public hearing prior to submission of the CDBG application.
This hearing must be held at a convenient time and location to encourage citizen
participation.
2. Publish an official announcement of the hearing, providing reasonable advance
notice. A sample public hearing notice with required language is provided on
page 25.
3. Distribute information on the availability of CDBG funds and the eligible uses at the
public hearing. Sample fact sheets are provided on pages 26 and 27. The hearing
minutes must reflect that these handouts were distributed at the public hearing.
4, NEW! Review local demographic data to determine if it is reasonable to
expect a significant number of non-English speaking residents to participate
in the public hearing and advertise and conduct the pUblic hearing in
accordance with this determination. Detailed guidance on providing and

5. Adopt a grievance procedure for the use of CDBG funds, A sample grievance
procedure is provided on page 28.
6. Document that the notice was published and the hearing was held. A

DETAILED INFORMATION ON THE REQUIREMENTS
1. Public Hearing Logistics
What is a public hearina? - A public hearing is a meeting of a governmental body
during which the public is invited to the council or board of county commissioners, who
will primarily listen and receive public input. A public hearing may be held as part of a
regularly scheduled public meeting where official decisions may then be made or where
it is elected to made a decision at a subsequent meeting.
Who must conduct the hearina? - The applicant city, town or county. Although some
applications are developed by other community organizations or special districts, these
organizations cannot conduct the hearing and have it meet CDBG requirements,
When must the hearina be held? - Prior to submission of the CDBG application and
within 18 months of the application submittal date.
Where must the hearina be held? - The hearing location must be accessible to persons
of disability, The location must also be convenient for persons likely impacted by the
proposed project. This is particularly relevant for a county proposing a project in a
community that is far from the county seat.
2. Public Hearing Notice
When must the advance notice be made? - Generally, a legal notice is published at
least one week prior to the hearing date. The notice must meet the local public hearing
notice requirements,
Where must the notice be made? - The hearing must be well-advertised, generally in
the official local paper. In addition, public notice can be made using community bulletin

boards, local newsletters, billing statements, newspaper articles or door-or-door
distribution. Residents within those areas in which CDBG funds are proposed to be
used, especially the low- and moderate-income persons, should be encouraged to
attend or provide comment.
For Public Service Grant applications: To further address the intent of the citizen
participation requirements to review community needs and the use of CDBG funds, it is
recommended the county and community action agency -
. Have the community action agency's most current Community Needs
Assessment available for review at the public hearing to support the need for
public service assistance and the allocation of funds;
, Identify those partner organizations that are proposed to be supported by CDBG
Public Service Grant funds; and
. Send notice of the public hearing to those partner organizations as an invitation
to participate in the public hearing discussions,
What must the notice say? - A sample notice is provided on page 25.
3. Public Hearing Purpose
What must the CDBG hearina cover? - The hearing is to obtain citizens' views and
respond to proposals and questions. It must cover community development and
housing needs and the availability of CDBG funds. The CDBG Program handout
materials are to be distributed. Additional handout materials describing the proposed
project(s) are advisable. A copy of the handout information in Spanish is available
from the CDBG· Program upon request.
4, Meeting the Needs of Non-English Speaking Residents
All applicants must complste the Outreach and Accommodation Form on page 23.
This form provides guidance on meeting this requirement, lists potential outreach steps
and accommodations and outlines how to document the efforts. The CDBG public
hearing should not be advertised or conducted without first ensuring appropriate
outreach and accommodations are accomplished.
The federal regulations on page 27 state IIpublic hearings shall be conducted in a
manner to meet the needs of non-English speaking residents where a significant
number of non-English speaking residents can reasonably be expected to participate,lI
The applicant jurisdiction must review local demographic data and consider the
potential impacts of the proposed project to determine the appropriate outreach steps
and accommodations to meet the needs of non-English speaking residents.
Data on the number and percent of non-English speaking residents in a jurisdiction can
be found by accessing the 2000 Census website at www.census.aov and then following

Overview
Community Development Block Grant (CDBG) Public Service Grants are awarded to
non entitlement counties throughout the state to support partnerships with local Community
Action Agencies (CAA) in conjunction with Community Service Block Grant (CSBG) funds
administered by the Office of Community Development's Community Services Division. These
funds address the root causes of poverty and help poor families and individuals regain or retain
self-sufficiency. A fund of up to 15 percent of the state's full annual CDBG award from Housing
and Urban Development (HUD) is set aside to award county/CM partnerships on a formula
basis,

Federal Citizen Participation Requirements
For Local Government Applicants to the State CDBG Proqram
Federal Reoulations 24 CFR 570.486 (a)
(a) Citizen participation requirements of a unit of general local government. Each unit of
general local government shall meet the following requirements as required by the state at
Sec, 91.115(e) of this title.
(1) Provide for and encourage citizen participation, particularly by low and moderate income
persons who reside in slum or blighted areas and areas in which CDBG funds are
proposed to be used;
(2) Ensure that citizens will be given reasonable and timely access to local meetings,
information, and records relating to the unit of local government's proposed and actual
use of CDBG funds;
(3) Furnish citizens information, including but not limited to:
(i) The amount of CDBG funds expected to be made available for the current fiscal
year (including the grant and anticipated program income);
(ii) The range of activities that may be undertaken with the CDBG funds;
(iii) The estimated amount of the CDBG funds proposed to be used for activities
that will meet the national objective of benefit to low and moderate income
persons; and
(iv) The proposed CDBG activities likely to result in displacement and the unit of
general local government's anti-displacement and relocation plans required
under Section 570.488.
(4) Provide technical assistance to groups representative of persons of low and moderate
income that request assistance in developing proposals in accordance with the
procedures developed by the state, Such assistance need not include providing funds
to such groups;
(5) Provide for a minimum of two public hearings, each at a different stage of the program,
for the purpose of obtaining citizens' views and responding to proposals and questions,
Together the hearings must cover community development and housing needs,
development of proposed activities and a review of program performance. The public
hearings to cover community development and housing needs must be held before
submission of an application to the state. There must be reasonable notice of the
hearings and they must be hold at times and locations convenient to potential or actual
beneficiaries, with accommodations for the handicapped. Public hearings shall be
conducted in a manner to meet the needs of non-English speaking residents where a
significant number of non-English speaking residents can reasonably be expected to
partïcipate;
(6) Provide citizens with reasonable advance notice of, and opportunity to comment on,
proposed activities in an application to the state and, for grants already made, activities
which are proposed to be added, deleted or substantially changed from the unit of
general local government's application to the state, Substantially changed means

criteria established by the state,

official to submit the CDBG application to the Washington State Office of Community
Development (OGD) and certify compliance with state and federal laws and specific program
requirements.

information as indicated. This resolution may be reformatted to meet the jurisdiction's
requirements for official resolutions.

INSTRUCTIONS FOR CDBG DISCLOSURE REPORT
All applicants for CDBG funds must complete and submit with their application
Parts I and /I of the Disclosure Report. At the completion of Part /I of the report,
some applicants will find that they must complete Parts 11/, IV, V, and VI of the
report. Parts /I and VI (if applicable) must be signed by the Chief Administrative
Official (mayor, county commission chair, county administrator, or city manager).
Part I requires the applicant's name, address, phone, and Federal Employer
Identification Number; indications as to whether this is an initial report or an update; the
fiscal year CDBG funds subject to the disclosure; a check as to whether the disclosure
is related to an entitlement; the amount of any CDBG program income earned from
previous CDBG-funded projects that will be used with the proposed CDBG funds; and
the total amount (proposed funds and program income).
Part II asks two questions. If the answer to both questions is "no", the applicant must
provide the certification at the end of Part II, but is not required to complete the
remainder of the report. If the answer to either question is "yes", then the applicant
must provide the certification at the end of Part II, and complete the remainder of the
report. Following these instructions IS a list of all the HUD Programs that are subject to
these disclosure requirements.
Part III requires information on any other government assistance that is to be used in
conjunction with the proposed CDBG project. "Other government assistance" means
any loan, grant, guarantee, insurance, payment, rebate, subsidy, credit, tax benefit, or
any other assistance (administered by federal, state, or a unit of genera/local
government) other than the CDBG funds requested in the application.
Part IV requires the identification of interested parties. Interested parties are persons
and entities such as subrecipients with a reportable financial interest in the project. If
an entity is being disclosed, the disclosure in Part IV must include an identification of
each officer, director, principal stockholder, or other official of the entity. All
consultants, developers, or contractors involved in the application for CDBG assistance,
or in the planning, development, or implementation of the project, must be identified as
an interested party, Also, any other person or entity that has a pecuniary interest in the
project that exceeds $50,000 or ten percent of the CDBG assistance, whichever is ,
lower, must be listed as an interested party. Pecuniary interest means any financial
involvement in the project, including (but not limited to) situations in which a person or
entity has an equity interest in the project, shares in any profit or resale or any
distribution of surplus cash or other assets of the project, or receives compensation for
any goods or services provided in connection with the project. (The following are not
considered interested parties: local CDBG administration staff, recipients of housing
rehabilitation assistance, and rehabilitation contractors as long as the rehabilitation
agreement is between the property owner and the contractor,)
It is realized that at the time of application, applicants may not be aware of all interested
parties since contracts and agreements for goods and services are not generally
awarded until after notice of grant award. Subsequent to grant award, as projects are
being implemented, funds will be committed to interested parties which will necessitate
the submission of an updated Disclosure Report. However, if an applicant for CDBG
funds identifies, under Part III of the Disclosure Report, other governmental assistance
that is to be used in conjunction with projects funded with CDBG funds, and if these

other funds have been committed to interested parties, then these interested parties
must be identified in Part IV of the initial report.
Part V requires applicants to identify the sources and uses of all funds to be used in
conjunction with the CDBG-funded project. The sources and uses must include all the
other assistance identified in Part III, as well as the CDBG funds identified in Part I,
items 3.c) and 3.d), Sources should be listed, with the amount, in descending order,

LIST OF HUD PROGRAMS
This is a list of all the HUD Programs that are subject to the disclosure requirements of Subpart
C of 24 CFR Part 12. All applicants for CDSG funds must review this list to determine if they
are receiving, or expect to receive, assistance from other covered programs in addition to
CDBG funds. Applicants must consider all HUD funds that are received either directly from
HUD or through the state. Applicants must consider all HUD funds that are received, whether
for the current project or other projects administered by the jurisdiction. The state-administered

as grant subrecipient. This agreement must be fully executed and submitted to the CDBG
Program before the 2002 grant funds can be released. The county can amend its current

To avoid difficulties commonly associated with subrecipient agreements, the county should

FEDERAL STANDARD PROVISIONS
FOR THE SUBRECIPIENT AGREEMENT
TITLE VI OF THE CIVIL RIGHTS ACT OF 1964 CLAUSE
Under Title VI of the Civil Rights Act of 1964, no person shall, on the grounds of race, religion,
color, or national origin, be excluded from participation in, be denied the benefits of, or be
subjected to discrimination under any program or activity receiving federal financial assistance.
ACCESS TO RECORDS CLAUSE
The county, the State of Washington Department of Community, Trade and Economic
Development, and other authorized representatives of the state and federal governments shall
have access to any books, documents, papers, and records of the Consultant which are directly
pertinent to the contract for the purposes of making audit, examination, excerpts, and
transcriptions.
SECTION 109 OF THE HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974
CLAUSE
No person in the United States shall on the grounds of race, color, national origin, or sex be
excluded from participation in, be denied the benefits of, or be subjected to discrimination under
any program or activity funded in whole or in part with funds made available under this title.
THE AGE DISCRIMINATION ACT OF 1975, AS AMENDED
This Act provides that no person shall be excluded from participation, denied program benefits,
or subjected to discrimination on the basis of age under any program or activity receiving
federal funds.
SECTION 504 OF THE REHABILITATION ACT OF 1973, AS AMENDED
Section 504 of the Rehabilitation Act of 1973, as amended, provides that no otherwise qualified
individual shall, solely by reasons of his or her handicap, be excluded from participation in
(including employment), denied program benefits of, or subjected to discrimination under any
program or activity receiving federal funding assistance.
CONFLICT OF INTEREST
No officer or employee of the Department; no member, officer, or employee of the Grantee or
its designees or agents; no member of the governing body of the jurisdiction in which the
project is undertaken or located; and no other official of such locality or localities who exercises
any functions or responsibilities with respect to the project during his or her tenure, shall have
any personal or pecuniary gain or interest, direct or indirect, in any contract, subcontract, or the
proceeds thereof, for work to be performed in connection with the project assisted under this
contract agreement.
SECTION 3 COMPLIANCE IN THE PROVISION OF TRAINING. EMPLOYMENT AND
BUSINESS OPPORTUNITIES CLA.USE
a) The work to be performed under this contract is on a project assisted under a program
providing direct federal financial assistance from the Department of Housing and Urban
Development and is subject to the requirements of Section 3 of the Housing and Urban
Development Act of 1968, as amended, 12 U.S.C. 1701u. Section 3 requires that to the
greatest extent feasible, opportunities for training and employment be given lower-income
residents of the project area and contracts for work in connection with the project be
awarded to business concerns which are located in, or owned in substantial part by persons
residing in the area of the project.

b) The parties to this contract will comply with the provisions of said Section 3 and the
regulations issued pursuant thereto by the Secretary of Housing and Urban Development
set forth in 24 CFR 135, and all applicable rules and orders of the Department issued
thereunder prior to the execution of this contract. The parties to this contract certify and
agree that they are under no contractual or other disability which would prevent them from
complying with these provisions.
c) The Subrecipient will send to each labor organization or representative of workers with
which he has a collective bargaining agreement or other contract or understanding, if any, a
notice advising the said labor organization or worker's representative of his commitments
under this Section 3 clause and shall post copies of the notice in conspicuous places
available to employees and applicants for employment or training.
d) The Subrecipient will include this Section 3 clause in every subcontract for work in
connection with the project and will, at the direction of the applicant for, or recipient of
. federal financial assistance, take appropriate action pursuant to the subcontract upon a
finding that the subcontractor is in violation of regulations issued by the Secretary of
Housing and Urban Development, 24 CFR Part 135, The Subrecipient will not subcontract
with any subcontractor where it has notice or knowledge that the latter has been found in
violation of regulations under 24 CFR Part 135 and will not let any subcontract unless the
subcontractor has first provided it with a preliminary statement of ability to comply with the
requirements of these regulations.
Compliance with the provisions of Section 3, the regulations set forth in 24 CFR Part 135, and
all applicable rules and orders of the Department issued hereunder prior to the execution of the
contract, shall be a condition of the federal financial assistance provided to the project, binding
upon the applicant or recipient for such assistance, its successors and assigns, Failure to fulfill
these requirements shall subject the applicant or recipient, its consultants and subcontractors,
its successors and assigns to those sanctions specified by the grant or loan agreement or
contract through which federal assistance is provided, and to such sanctions as are specified by
24 CFR Part 135.

SUMMARY STATEMENT: Council previously approved a Sept 4 letter to BOCC (attached)
setting forth the City position on Glen Cove issues. By letter dated Nov, 14,2002 (attached),
County Administrator forwarded a staff proposal, and invited a meeting of elected officials to
discuss the proposal. On Nov. 26, Commissioners Wojt and Tittemess, and Councilors Kolff,
Fenn and Sandoval met. "Glen Cove Issues" (attached) summarizes County and City positions
as of the Nov. 26 meeting. The "Tentative Resolution ofIssues" Table (Nov. 26, 2002)
(attached) reflects tentative compromise on issues reached at the Nov. 26 meeting.
By way of background, the City and County entered into a Memorandum of Understanding
(MOU) dated Apnl 8, 2002 to collaboratively and in good faith work together to seek agreement
on Glen Cove LAMIRD issues. The County agreed it would not take action to revise LAMIRD
boundaries until the City and County reached agreement. In the MOU, City and County agreed
to retain an expert to render an opinion on LAMIRD boundary designation. City and County
agreed on William Nielsen (a growth board member) as the expert. In the Nielsen Report dated
April 24, 2002, Mr, Nielsen states there are three parts to designating a GMA compliant
LAMIRD: (1) what are existing areas (delineated predominantly by the built environment) as of
1990, (2) what are logical outer boundaries (based on, among other criteria, need to preserve the
character of existing natural neighborhoods, and physical boundaries), and (3) existing uses
(namely, limiting uses generally to 1990 uses). The tentative agreement if approved by Council
would represent a compromise on these issues in the spirit of good faith, as the parties committed
in the MOD. The County desires City support on LAMIRD issues because the County believes
that it will assist the County in the vent of third party legal challenge.
