WHEREAS, the above-described road was vacated by operation of law and the County divested of its interest before the 1909 amendment, Laws of 1909, Chapter 90, Section 1, became effective, which exempted from vacation by operation of law certain lands dedicate? for road purposes; and WHEREAS, the Jefferson County Board of Commissioners desires to remove this cloud on title to the real property; NOW, THEREFORE BE IT RESOLVED that the dedicated platted road more particularly described above has been vacated by operation of law and Jefferson County asserts no claim of interest for public road purposes in them. Rowe, P.E., Public Works Director/County Engineer MEMORANDUM TO: Board of County Commissioners FROM: Gary Rowe, Public Works Director ~~ ~?ð1-' DATE: December 20, 2000 SUBJECT: Engineer's Report on Request to Vacate Florence Avenue Arnold and Alison Wood, Petitioners In accordance with Chapter 36.87 RCW, I have examined the platted right of way, described as follows: That portion of platted Florence Avenue being approximately 80 feet in width and 300 feet in length adjoining the west half of vacated Second St., Block 21, the east half of vacated Third St., and that portion of platted Cedar St. being approximately 30 feet in width and 30 feet in length located in the southwest quarter of the intersection of Second S1. and that portion of Cedar St. being approximately 30 feet in width and 60 feet in length located in the south half of the intersection of Third S1. situated in Section 16, Township 30 North, Range 1 West WM, in the Plat ofIrving Park, Vol. 1 of Plats Page 42, Records ofJefferson County, Washington. As petitioned by Arnold Wood for statutory vacation, and herewith submit the following report thereon: 1. The Streets were platted on May 5, 1888 in the Plat ofIrving Park and therefore are vacated under the Road Vacation Ordinance No. 07-0809-99. 2. There were no roads constructed within this right of way within five (5) years of the date of platting. 3. There is no current of anticipated future public need for the right of way to provide for the public road circulation network nor for public access. 4. The public will benefit by returning the property being vacated to the tax rolls, by enhancement of the development potential of the property, and by increasing the taxable value of the property once the vacation is completed.
