WHEREAS, the Jefferson County Board of Commissioners has reviewed a road vacation petition submitted by
Thomas E. Fair; and
WHEREAS, real property was dedicated to Jefferson County for road purposes in an instrument dated Garfield's
Addition to Harrisburg and filed with the Jefferson County Auditor at Page 39, Volume 2 of Plats; and
WHEREAS, Jefferson County has not opened the following described right of way for public use for road purposes
within five (5) years of obtaining an interest in the real property for road purposes:
That portion of platted Pine Street, being approximately 135 feet in length and 50 feet in width, lying between the south half of
Block 6 and the south half of Block 5, situated in section 2, Township 29 North, Range 1 West WM, in the plat of Garfield's
Addition, Vol. 2 of Plats Page 39, Records of Jefferson County, Washington.
WHEREAS, the above-described road was vacated by operation of law and the County divested of its interest before
the 1909 amendment, Laws of 1909, Chapter 90, Section 1, became effective, which exempted from vacation by operation of
law certain lands dedicated for road purposes; and
WHEREAS, the Jefferson County Board of Commissioners desires to remove this cloud on title to the real property;
NOW, THEREFORE BE IT RESOLVED that the dedicated platted road more particularly described above has been
vacated by operation of law and Jefferson County asserts no claim of interest for public road purposes in them. Said vacated
road shall be attached to real property owned by Thomas E. Fair.
Utility rights, private easements, or other rights or interests may still exist.

Engineer's Report on Request to Vacate - Portion of Pine St. in the Plat of Garfield's
Addition / Petitioner - Thomas E. Fair
In accordance with Ch 36.87 RCW, I have examined the above referenced road, and submit the following
report.
FINDINGS:
1. That portion of Pine Street requested for vacation was dedicated in the plat of Garfield's Addition
to Harrisburg on January 17, 1890 and therefore is vacated under Ch. 36.87.090 RCW.
2. The request is to vacate that portion of platted Pine S1. being approximately 50' in width and 135' in
length lying between the south half of Block 6 and the south half of Block 5, situated in Section 2,
Township 29 North, Range 1 west WM, in the plat of Garfield's Addition to Harrisburg, Vol. 2 of Plats
Page 39, records of Jefferson County, Washington.
3. There were no roads constructed within this right of way within five (5) years of the date of platting.
4. Presently, these rights of way are not part of any proposed or future trail projects nor do they
provide access to any public destination. Therefore, the public will benefit by returning'this
property to the tax rolls, by enhancement of the ability to develop the property, and by increasing
the taxable value of the property once the vacation is completed.
RECOMMENDATION:
Therefore, based on the foregoing Findings, the Department of Public Works recommends that the Board
of County Commissioners approve this vacation request.
