HomeMy WebLinkAbout111521ca01 JEFFERSON COUNTY BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST TO: Board of County Commissioners FROM: Adiel McKnight, Executive Assistant DATE: November 15, 2021 RE: In the Matter of Amending Resolution No. 60-18 (Approving a System of Rates and Charges on Parcels within the Jefferson County Conservation District, Providing Revenues to the District for Services Benefiting Properties Therein) to Correct Scrivener's Error STATEMENT OF ISSUE: On November 26, 2018, the Jefferson County Board of County Commissioners (Board) held a duly noticed public hearing to consider a resolution fixing rates and charges for the Jefferson County Conservation District. The Board deliberated then approved and signed the proposed resolution, Resolution No. 60-18, after considering written and verbal testimony. ANALYSIS: Upon subsequent review by the Jefferson County Assessor, Jeff Chapman, he determined that there was a scrivener's error in the Land Classification and Rate table contained in Exhibit 1 of the resolution. Land Use Category No. 1 is listed as Recreation in that table. It should have been listed as Residential. This action proposes that the resolution be amended to correct that error. FISCAL IMPACT: N/A RECOMMENDATION: Approve a motion to amend Resolution No. 60-18 to correct the scrivener's error discussed above. County Conservation District, Providing Revenues to the District for Services Benefiting Properties Therein) to Correct Scrivener's Error; WHEREAS, On November 26, 2018, the Jefferson County Board of County Commissioners (Board) held a duly noticed public hearing to consider a resolution fixing rates and charges for the Jefferson County Conservation District; and, WHEREAS The Board deliberated then approved and signed the proposed resolution, Resolution No. 60-18, after considering written and verbal testimony; and, WHEREAS,the Growth Management Act,Chapter 36.70A RCW requires the County to plan consistent with its provisions; and WHEREAS, The Jefferson County Assessor, Jeff Chapman, he determined upon subsequent review that there was a scrivener's error in the Land Classification and Rate table contained in Exhibit 1 of Resolution No. 60-18; and WHEREAS, Land Use Category No. 1 is listed incorrectly as "Recreation" in the Land Classification and Rate table contained in Exhibit 1 of Resolution No. 60-18; and WHEREAS,Land Use Category No. 1 should have been listed as"Residential;" and WHEREAS, the Board wants to correct the scrivener's error; and NOW THEREFORE,BE IT ORDAINED BY THE JEFFERSON COUNTY BOARD OF COMMISSIONERS: Section 1.Correction of Scrivener's Error. Land Classification&Rate Table in Exhibit 1 now reads: LAND USE CATEGORY PARCEL PER ACRE RATE RATE 1-Recreation $5.00 $0.10 2-Commercial; $4.98 $0.08 3-Agriculture; $4.99 $0.10 4-lnstitutional/Public; $4.98 $0.08 Page 1 of 3 LAND USE CATEGORY PARCEL PER ACRE RATE RATE 5-Vacant/Undeveloped; $4.98 $0.08 6-Open Space; $4.99 $0.08 7-Forested; $4.99 $0.08 8-Timberland(DFL/OST/DNR) $2.99 $0.01 Land Classification&Rate Table in Exhibit 1 now amended to read: LAND USE CATEGORY PARCEL PER ACRE RATE RATE 1-Residential $5.00 $0.10 2-Commercial; $4.98 $0.08 3-Agriculture; $4.99 $0.10 4-1nstitutional/Public; $4.98 $0.08 5-Vacant/Undeveloped; $4.98 $0.08 6-Open Space; $4.99 $0.08 7-Forested; $4.99 $0.08 8-Timberland(DFL/OST/DNR) $2.99 $0.01 All other provisions of Resolution No. 60-18 remain unchanged. Section 2. Effective Date. This resolution shall take effect and be in full force and effect immediately upon passage. Section 3. Severability. The provisions of this resolution are severable. If any section, sentence, clause or phrase of this resolution or its application to any person or circumstance is held to be unconstitutional or unlawful by a court of competent jurisdiction, the remainder of this resolution or application of its provisions or other persons or circumstances shall remain valid and unaffected.
