Dear Mr. Fleming and Mr. Kuzma,
We are in receipt of your Memorandum dated 4/6/2021 to Shannen Cartmel. The purpose of this letter is
to respond and provide additional clarification and responses to your Preliminary Findings and Initial
Comments portion of the Memorandum referenced above. I will address each item in the order in which
they were received as follows:
Preliminary Findings:
The BLA proposal is to reconfigure and reduce 135 lots of record to 70 lots. This reduction in existing
parcels makes provisions for larger lots with a minimum lot size of 12,500 square feet in lieu of 5,000
square feet as platted, which is significantly larger and much more compliant than the existing platted
lots.
Please note there are two related but distinct applications which are as follows: 1) The BLA, which
reconfigures the lots within the Irvington Addition Plat into 70 lots, and 2) The Clearing and Grading
permit of which requires the SEPA checklist, which in turn requires us to address all future project
actions. The SEPA included additional adjacent parcels to the east and the west that increases both the
land area and the number of potential building lots above what is referenced in the BLA. This distinction
is relevant for two reasons: 1) Several SEPA related items are not applicable to the BLA, which is a Type
1 permit that is exempt from SEPA, and 2) There are some future activities described in the SEPA that are
beyond the scope of the Clearing and Grading permit application.
Initial Comments:
1. We understand this request and plan to comply with the applicable rules and regulations when it is
time for site engineering. We agree minimum requirements 1 through 9 per Dept of Ecology Stormwater
Management Manual for Western WA will apply for stormwater quality and quantity. If deemed
necessary please condition the project accordingly. Once the BLA is recorded we plan to move forward
with preparing and submitting site development plans accordingly.

2. Noted. Appropriate items will be revised and submitted once the BLA is approved.
3. The BLA is proposing to reduce a recorded and recognized 135 lots to 70 lots and typically a TIA
would not be a requirement as the lots have existed for over 100 years, since 1890. However, our client
offered up a TIA which further shows and clarifies that there are no negative impacts to the existing road
network and the proposed access locations are appropriate. A submission of the TIA was submitted on
April 1, 2021 to Jefferson County.
4. Thank you and your comments are noted. A permanent cul-de-sac with a potential gated emergency
vehicle access will be proposed to serve these lots. This will be completed during the site development
application stage through Civil Engineering design requirements post BLA recording. See revised site
plan for conceptual location of a proposed cul-de-sac.
Optionally we may ask to consider widening Nelson's landing Road to a wider more appropriate standard
which may allow for a direct connection but if this doesn't become an option then we would fall back to
the before mentioned cul-de-sac with potential to make an EVA connection to Nelson's Landing Road.
5. Noted and the road approach applications were required when submitting the BLA.
6. Please see revised site plan which includes proposed roadway sections, private road easement widths
and utility easements as applicable. We are proposing a minor modification of the Local Access Road
from a 60-foot wide section to a 40-foot wide road easement with 10-foot utility easements on both sides
for an effective width of sixty feet. Also, please note we are proposing a single -slope road for storm
drainage control utilizing biofiltration retention swales.
7. Once the BLA is approved and recorded a site development plan will be developed by a Professional
Civil Engineer that will show grading for the roads, parcels, building pads etc... It should be noted that
we have been and will continue to coordinate all proposed improvements with a reputable septic designer
in Jefferson County.
8. Noted. Quiet Title Judgment was recorded 4/15/2021 under Cause # 20-2-00193-6 Jefferson County
Superior Court.
