Governor Inslee recently signed the 2021 State Capital Budget, which includes the approval of 35 local Infrastructure Projects funded under Sec. 1085 for the Department of Commerce (copy of Sec. 1085 attached). You are receiving this email because your project is one of those Infrastructure Projects. These projects are being funded with a portion of the state’s allocation of State and Local Fiscal Recovery funds through the federal American Rescue Plan Act (ARPA) through the US Treasury. The US Treasury has released FAQs, Interim Final Rule, Compliance and Reporting Guidance, and a fact sheet on their webpage HERE. Due to these projects being funded from a new federal program, there is some delay in getting these funds out. We are working diligently to confirm each project’s eligibility and review the federal compliance and reporting requirements applicable to these project in order to proceed. In fact, the US Treasury just released the compliance reporting requirements for this funding on June 24 and updated the FAQ’s as recently as July 19. In addition to these projects being federally funded and must follow federal program requirements, per the legislative appropriation in Sec. 1085, there are state legislative pre-contracting requirements that will need to be met before these projects can access funds. We are anticipating to have project eligibility determinations completed, and award letters and program guidelines for these Infrastructure project funds available within the next 30 days. We are also anticipating the US Treasury releasing their final rule any day now. Please know we are working to get these funds out as quickly as we can. We hope this is update is helpful.
