Sec. 1085. FOR THE DEPARTMENT OF COMMERCE35 Infrastructure Projects (91001687)36 The appropriation in this section is subject to the following 37 conditions and limitations:38 p. 72 SHB 1080.PL (1) The department may not expend the appropriation in this 1 section unless and until the nonstate share of project costs have 2 been either expended or firmly committed, or both, in an amount 3 sufficient to complete the project or a distinct phase of the project 4 that is useable to the public for the purpose intended by the 5 legislature. This requirement does not apply to projects where a 6 share of the appropriation is for design costs only.7 (2) Prior to receiving funds, project recipients must demonstrate 8 that the project site is under control for a minimum of 10 years, 9 either through ownership or a long-term lease. This requirement does 10 not apply to appropriations for preconstruction activities or 11 appropriations in which the sole purpose is to purchase real property 12 that does not include a construction or renovation component.13 (3) Projects funded in this section may be required to comply 14 with Washington's high-performance building standards as required by 15 chapter 39.35D RCW.16 (4) Project funds are available on a reimbursement basis only, 17 and may not be advanced under any circumstances.18 (5) In contracts for grants authorized under this section, the 19 department must include provisions that require that capital 20 improvements be held by the grantee for a specified period of time 21 appropriate to the amount of the grant and that facilities be used 22 for the express purpose of the grant. Sec. 1086. FOR THE DEPARTMENT OF COMMERCE20 2021-23 Broadband Office (92000953)21 The appropriations in this section are subject to the following 22 conditions and limitations:23 (1)(a) The appropriations in this section are provided solely to 24 the statewide broadband office for qualifying broadband 25 infrastructure projects.26 (b) Unless otherwise stated, eligible applicants for grants 27 awarded under subsections (2) and (3) of this section are:28 (i) Local governments, including ports and public utility 29 districts;30 (ii) Federally recognized tribes;31 (iii) Nonprofit organizations;32 (iv) Nonprofit cooperative organizations; and33 (v) Multiparty entities comprised of a combination of public 34 entity members or private entity members.
