HomeMy WebLinkAboutScott Boyd Settlement 2015MEMORANDUM OF SETTLEMENT by and between JEFFERSON COUNTY AND TEAMSTERS LOCAL 589 A. Scott Boyd (Boyd) is a Deputy Sheriff working within the Jefferson County Sheriff's Office JCSO), and; B. The JCSO Deputies are represented by Teamsters 589 (Union) pursuant to RCW 41.56, and; C. Jefferson County and the Union have entered into a Collective Bargaining Agreement (CBA), and; D. The Union has filed a grievance on behalf of Boyd comprised of multiple claims of CBA, Statutory and other unspecified violations, and; E. The parties having meet and discussed the issues wish to resolve all issues related to or arising from the facts in this matter. THEREFORE IT IS AGREED 1. This settlement resolves all issues and claims arising from the facts associated with Boyd being assigned the duties and responsibilities of K-9 Officer. This settlement is for the period from the date of first assignment through the date this settlement is signed by Boyd below. 2. All parties agree there are no recognized valid claims or cross claims in the settlement of all issues be they filed or not in the referenced grievance or filed or not with any other party. This settlement is without precedence, or evidentiary and/or citation value for any other claim by any party in any forum. 3. Each party agrees it is in their best interest to settle all possible claims by Boyd be they under the CBA, Statute or other authority rather than incur protracted and distracting processes to establish and enforce their relative position. The recognition of the value of settlement, with other good and valued consideration including payments to Boyd herein, is acknowledged by each Parry as forming ample consideration for binding each ofthe Parties to this agreement. 4. Boyd shall be paid a gross wage sum of four thousand dollars ($4,000.00) less all ordinary payroll deductions. This payment is in full, final and complete satisfaction of all known and unknown claims arising from his assignment and his activities as a K-9 Officer from the beginning of such assignment through the date of signing below. 5. The Parties agree this settlement in its entirety shall be confidential and that the terms shall not be disclosed by any party except as may be required for enforcement, by law or court order. Each Parry shall simply state "all issues regarding Deputy Boyd's concerns have been resolved" upon any inquiry into the matter. Should a Party be required to disclose they will notify all other Parties within 72 hours of their duty to disclose. The foregoing being the agreement of the Parties each has signed and dated this Agreement to become binding on the signing party as of the date signed by the signatore.
