WHEREAS, the Jefferson County Board of Commissioners has reviewed a road vacation petition
submitted by Jerry Lanphear; and
WHEREAS, real property was dedicated to Jefferson County for road purposes in an instrument
dated May 16, 1890 and filed with the Jefferson County Auditor at Page 76, Volume 2 of Plats; and
WHEREAS, Jefferson County has not opened the following described right of way for public use
for road purposes within five (5) years of obtaining an interest in the real property for road purposes:
That portion of platted Holly Street being approximately 30 feet in width and 272.5 feet in length adjacent
to and contiguous with Lot 16 of Block 4 and Lot 15 of Block 5 located in the Plat of Evergreen Addition
to the City of Port Townsend, and, that portion of Evergreen Avenue being approximately 60 feet in width
and 200 feet in length adjacent to and contiguous with Lots 11 through 15 of Block 5 and Lots 16 through
20 of Block 4 all located in the Plat of Evergreen Addition to the City of Port Townsend at Vol. 2, Page 76,
Section 9, Township 30 North, Range 1 West, records of Jefferson County, Washington.
WHEREAS, the above-described road was vacated by operation of law and the County divested of
its interest before the 1909 amendment, Laws of 1909, Chapter 90, Section 1, became effective, which
exempted from vacation by operation of law certain lands dedicated for road purposes; and
WHEREAS, the Jefferson County Board of Commissioners desires to remove this cloud on title to
the real property;
NOW, THEREFORE BE IT RESOLVED that the dedicated platted road more particularly
described above has been vacated by operation oflaw and Jefferson County asserts no claim of interest for
public road purposes in them. Utility rights, private easements, or other rights or interests may still exist.

Engineer's Report on Request to Vacate a Portion of Holly St. &
Evergreen Ave., Plat of Evergreen Addition, Jerry Lanphear Petitioner

In accordance with Ch 36.87 RCW, I have examined the platted right of way, described as
follows:
That portion of platted Holly Street being approximately 30 feet in width and 272.5 feet
in length adjacent to and contiguous with Lot 16 of Block 4 and Lot 15 of Block 5
located in the Plat of Evergreen Addition to the City of Port Townsend, and, that portion
of Evergreen Avenue being approximately 60 feet in width and 200 feet in length
adjacent to and contiguous with Lots 11 through 15 of Block 5 and Lots 16 through 20 of
Block 4 all located in the Plat of Evergreen Addition to the City of Port Townsend at Vol.
2, Page 76, Section 9, Township 30 North, Range 1 West, records of Jefferson County,
Washington.
and as petitioned by Jerry Lanphear for statutory vacation, and herewith submit the following
report thereon:
1. The streets were platted on May 16, 1890 in the Plat of Evergreen Addition and therefore are
vacated under the Road Vacation Ordinance No. 07-0809-99.
2. To the best of my knowledge, there were no roads constructed within this right of way within
five (5) years of the date of platting.
3. Although there appears to be recent private use within the Evergreen Avenue right way,
based on information available at this time, research has indicated that there were no roads
constructed within this right of way within five (5) years of the date of platting.
4. The public will benefit by returning the property being vacated to the tax rolls, by
enhancement of the development potential of the property, and by increasing the taxable
value of the property once the vacation is completed.
Therefore, for the reasons stated above, it is recommended that the Board of County
Commissioners approve this vacation request.
