Parcel numbers: 973500204, 973500205, 973500208, 973500210, 901023006 & 901024075 ------------------_n_--------_------------------------------------------_--n_--_----------------------------__n------_----------------------------------- STATE OF WASHINGTON COUNTY OF JEFFERSON In the matter of x Resolution No. 17-00 The Statutory Vacation of A Portion of Blanche Ave. & Marion S1. in the Plat of Morrissey's Addition x x x WHEREAS, the Jefferson County Board of Commissioners has reviewed a road vacation petition submitted by Nancy Stratton; and WHEREAS, real property was dedicated to Jefferson County for road purposes in an instrument dated April 14, 1890 and filed with the Jefferson County Auditor at Page 69, Volume 2 of Plats; and WHEREAS, Jefferson County has not opened the following described right of way for public use for road purposes within five (5) years of obtaining an interest in the real property for road purposes: That portion of Blanche Avenue being approximately 40 feet in width and 260 feet in length adjacent to and coincident with Lots 16, 17, 18, 19,20,21 and the West Y2 of Lot 22 of Block 2, and, that portion of Marion Street being approximately 30 feet in width and 125 feet in length adjacent to and coincident with Lot 16 of Block 2, all located in the Plat of Morrissey's Addition to Hadlock, Vol. 2, Page 69, Section 2, Township 29 North, Range 1 West, records of Jefferson County, Washington. WHEREAS, the above-described road was vacated by operation of law and the County divested of its interest before the 1909 amendment, Laws of 1909, Chapter 90, Section 1, became effective, which exempted from vacation by operation of law certain lands dedicated for road purposes; and WHEREAS, the Jefferson County Board of Commissioners desires to remove this cloud on title to the real property; NOW, THEREFORE BE IT RESOLVED that the dedicated platted road more particularly described above has been vacated by operation of law and Jefferson County asserts no claim of interest for public road purposes in them. Rowe, P.E., Public Works Director/County Engineer MEMORANDUM Board of County Commissioners Á . e--;) Gary Rowe, P.E., Public Works Director / County Engineer, Interim ~ ~ February 8, 2000 Engineer's Report on Request to Vacate a Portion of Blanche Ave. & Marion St. Plat of Morrissey' s Addition, Nancy Stratton Petitioner TO: FROM: DATE: SUBJECT: In accordance with Ch 36.87 RCW, I have examined the platted right of way, described as follows: That portion of platted_Blanche Avenue being approximately 40 feet in width and 260 feet in length adjacent to and coincident with Lots 16, 17, 18, 19,20,21 and the West ~ of Lot 22 of Block 2, and, that portion of Marion Street being approximately 30 feet in width and 125 feet in length adjacent to and coincident with Lot 16 of Block 2, all located in the Plat of Morrissey's Addition to Hadlock, Vol. 2, Page 69, Section 2, Township 29 North, Range 1 West, records of Jefferson County, Washington, and as petitioned by Nancy Stratton for statutory vacation, and herewith submit the following report thereon: 2. 3. 4. 1. The streets were platted on April 14, 1890 in the Plat of Morrissey's Addition and therefore are vacated under the Road Vacation Ordinance No. 06-062592-92. To the best of my knowledge, there were no roads constructed within this right of way within five (5) years ofthe date of platting. There is no current or anticipated future public need for the right of way to provide for the public road circulation network nor for public access. The public will benefit by returning the property being vacated to the tax rolls, by enhancement of the development potential of the property, and by increasing the taxable value of the property once the vacation is completed.
