A Portion of Platted Streets

WHEREAS, the Jefferson County Board of Commissioners has reviewed a road vacation petition
submitted by Ramon Broders and Richard Broders; and
WHEREAS, real property was dedicated to Jefferson County for road purposes in an instnunent dated
March 3, 1891 and filed with the Jefferson County Auditor at Page 103, Volume 2 of Plats; and
WHEREAS, Jefferson County has not opened the following described right of way for public use for road
purposes within five (5) years of obtaining an interest in the real property for road purposes:
The proposed area to be vacated is located in the Plat of Junction City, recorded at Volume 2, Page1O3 of
Plats, dated March 3, 1891, further described as follows:
That portion of Anchor Avenue being approximately 70 feet in width, lying southeasterly of and adjoining
Blocks 13,27,30 and lying northwesterly of and adjoining Blocks 12,28,and 29; also, that portion of
Broadway Avenue being approximately 80 feet in width, lying southeasterly of and adjoining Blocks 3 & 5
and lying northwesterly of and adjoining Blocks 11 & 4, excepting therefrom any County right of way
known as Old Gardiner Road, County Road # 501409;
Together with those portions of 2nd, 3rd, 41\ 5[\ 6ID, 7ID & 8ID Streets, each being approximately 60 feet in
width, each portion of said streets beginning at the easterly right of way margin of State Highway 101 (SR
101), and extending southeasterly to the limits of said plat and the shoreline of Discovery Bay, excepting
therefrom any County right of way known as Old Gardiner Road, County Road # 501409;
Together with the platted alleys with a width of approximately 20 feet located in Blocks 3,11,13,27,30,49
& 50 of said Plat, excepting therefrom any County right of way known as Old Gardiner Road, County
Road # 501409,
All lands described herein lie easterly of SR 101; situate in Section 13, Township 29 North, Range 2 West
and Section 18, Township 29 North, Range 1 West, WM., Jefferson County, State of Washington. This
road vacation affects parcel numbers: 964501201, 964501301, 964500202, 964505001, 964505002,
964504901, 964504902, 964502901, 964502801, 964501102, 964500401, 964500301, 964500502,
964501103,964501202,964501305,964503001 &964504903.
WHEREAS, the above-described road was vacated by operation of law and the County divested of its
interest before the 1909 amendment, Laws of 1909, Chapter 90, Section 1, became effective, which exempted from
vacation by operation of law certain lands dedicated for road purposes; and

WHEREAS, the Jefferson County Board of Commissioners desires to remove this cloud on title to the real
property;

NOW, THEREFORE BE IT RESOLVED that the dedicated platted road more particularly described above
has been vacated by operation of law and Jefferson County asserts no claim of interest for public road purposes in
them" Utility rights, private easements, or other rights or interests may still exist,

Engineer's Report on Request to Vacate Portions of Streets in the Plat of Junction City
Ramon Broders & Richard Broders, Petitioners
In accordance with Ch 36.87 RCW, I have examined the proposed area to be vacated as located in the Plat of
Junction City, recorded at Volume 2, Page 103 of Plats, dated March 3, 1891, described as follows:
That portion of Anchor Avenue being approximately 70 feet in width, lying southeasterly of and adjoining

This road vacation is being petitioned by Ramon Broders and Richard Broders for statutory vacation. I herewith
submit the following report thereon:
1. The streets were platted on March 3, 1891 in the Plat of Junction City and therefore are
vacated under the Road Vacation Ordinance No. 007-0809-99.
2. There were no roads constructed within this right of way within five (5) years of the date of
platting.

There is no current or anticipated future public need for the right of way to provide for the
public road circulation network nor for public access.
4.
The public will benefit by returning the property being vacated to the tax rolls, by
enhancement of the development potential of the property, and by increasing the taxable value
of the property once the vacation is completed.
Therefore, for the reasons stated above, it is recommended that the Board of County Commissioners approve
this vacation request.
