WHEREAS, the Jefferson County Board of Commissioners has reviewed a road vacation petition
submitted by James Eades; and
WHEREAS, real property was dedicated to Jefferson County for road purposes in an instrument dated
April4, 1890 and filed with the Jefferson County Auditor at Page 54 Volume 2 of Plats; and
WHEREAS, Jefferson County has not opened the following described right of way for public use for road
purposes within five (5) years of obtaining an interest in the real property for road purposes:
That portion of Bay View Street being approximately 60 feet in width and 150 feet in length adjoining Lots 4,5 & 6
of Block 26 and Lots 7, 8 & 9 of Block 17, and; that portion of Elizabeth Street being approximately 60 feet in
width and 330 feet in length adjoining Lots 6 & 7 of Block 26 and Lots 1 & 12 of Block 25, including the
intersections of Elizabeth Street with Charles and Bay View Streets, and; that portion of Charles Street being
approximately 60 feet in width and 150 feet in length adjoining Lots 7, 8 & 9 of Block 26 and Lots 4, 5 & 6 of

& 9, all located within the Plat of Eisenbeis Bay View Addition located in Vol. 2 Page 54 of Plats, Section 17,
Townsmp 30 North, Range 1 West, records ofJefferson COlillty, Washington.
WHEREAS, the above-described road was vacated by operation of law and the County divested of its
interest before the 1909 amendment, Laws of 1909, Chapter 90, Section 1, became effective, which exempted from
vacation by operation of law certain lands dedicated for road purposes; and
WHEREAS, the Jefferson County Board of Commissioners desires to remove this cloud on title to the real
property;
NOW, THEREFORE BE IT RESOLVED that the dedicated platted road more particularly described above
has been vacated by operation of law and Jefferson County asserts no claim of interest for public road purposes in
them. Utility rights, private easements, or other rights or interests may still exist.

Engineer's Report on Request to Vacate Portions of Charles, Bay View & Elizabeth Streets
Plat of Eisenbeis Bay View Addition, James Eades, Petitioner
In accordance with Ch 36.87 RCW, I have examined the platted right of way, described as follows:
That portion of platted Bay View Street being approximately 60 feet in width and 150 feet in length adjoining
Lots 4, 5 & 6 of Block 26 and Lots 7, 8 & 9 of Block 17, and; that portion of Elizabeth Street being
approximately 60 feet in width and 330 feet in length adjoining Lots 6 & 7 of Block 26 and Lots 1 & 12 of
Block 25, including the intersections of Elizabeth Street with Charles and Bay View Streets, and; that portion
of Charles Street being approximately 60 feet in width and 150 feet in length adjoining Lots 7,8 & 9 of Block
26 and Lots 4,5 & 6 of Block 31, and that portion of the alley in Block 26 being approximately 10 feet in
width adjoining Lots 4, 5, 6, 7, 8 & 9, all located within the Plat of Eisenbeis Bay View Addition located in
Vol. 2 Page 54 of Plats, Section 17, Township 30 North, Range 1 West, records ofJefferson County,
Washington.
and as petitioned by James Eades for statutory vacation, and herewith submit the following report thereon:
1.
The streets were platted on April 4, 1890 in the Plat of Eisenbeis Bay View and therefore are vacated under
the Road Vacation Ordinance No. 07-0809-99.
2.
There were no roads constructed within these rights of way within five (5) years of the date of platting.
3.
The public will benefit by returning the property being vacated to the tax rolls, by enhancement of the
development potential of the property, and by increasing the taxable value ofthe property once the
vacation is completed.
Therefore, for the reasons stated above, it is recommended that the Board of County Commissioners approve this
vacation request.
