WHEREAS, a private easement may exist within the above-described road which was vacated by operation oflaw and the County divested of its interest before the 1909 amendment, Laws of 1909, Chapter 90, Section 1, became effective, which exempted £rom vacation by operation of law certain lands dedicated for road purposes; and WHEREAS, the Jefferson County Board of Commissioners desires to remove this cloud on title to the real property; NOW, THEREFORE BE IT RESOLVED that the dedicated platted road more particularly described above has been vacated by operation of law and Jefferson County asserts no claim of interest for public road purposes in them. Rowe, P.E., Public Works Director/County Engineer MEMORANDUM TO: FROM: DATE: SUBJECT: Board of County Commissioners ¡" /l~ Gary Rowe, Public Works Director / County Engineer .6Ia.c.-, c..¡......¡,:çø--- June 26, 2000 Engineer's Report on Request to Vacate a Portion of Stevens Street, Plat of Harrisburg, Axon Taylor & Jennifer Sharko- Taylor, Petitioner In accordance with Ch 36.87 RCW, I have examined the platted right of way, described as follows: That portion of platted Stevens Street being approximately 29 feet in width and 125 feet in length adjoining Lots 11 & 12 of Block 8 located within the Supplemental Plat ofthe Town of Harrisburg located at Page 21, Volume 1 of Plats, Section 2, Township 29 North, Range 1 West, records of Jefferson County, Washington. and as petitioned by Axon Taylor & Jennifer Sharko-Tay1or for statutory vacation, and herewith submit the following report thereon: 1. The streets were platted on May 30, 1883 in the Supplemental Plat of the Town of Harrisburg and therefore is vacated under the Road Vacation Ordinance No. 07-0809-99. 2. Although Stevens Street has been opened for private use, it was not constructed within this right of way within five (5) years ofthe date of platting. The portion of Stevens Street that is opened lies within the right of way of Garfield's Additions which adjoins the Supplemental Plat ofthe Town of Harrisburg. 3. This portion of right of way has been used as access to property adjoining it and would be considered a private easement. This vacation removes any cloud on the title but does not vacate any private easements which may exist. 4.
