HomeMy WebLinkAbout012422ra01 JEFFERSON COUNTY BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST TO: Board of County Commissioners FROM: Mark McCauley,Interim County Administrator DATE: January 24,2022 RE: Public Hearing regarding a request for Board of County Commissioners approval of a proposed ordinance inactivating Fund 202-000-030-Road Improvement Bonds and Fund 602-000-010—Road Improvement Guaranty Fund STATEMENT OF ISSUE: On January 22,2001,the Board of County Commissioners voted unanimously to create Fund 602-000-010—Road Improvement Guaranty Fund.The fund was required in conjunction with the creation of Road Improvement District No.4 and the sale of bonds to finance related road improvements.Five thousand($5,000)was deposited into the fund upon its creation. The fund's purpose was to help make bond payments to avoid a default in the event one or more property owners failed to make required payments.The bonds have since been retired eliminating the need for the Road Improvement Guaranty Fund. Similarly,the Board established Fund 202-000-030 to account for funds associated with Road Improvement District #1 and a related financing bond.This fund is inactive and no longer needed. ANALYSIS: RCW 35.54.095 authorizes the transfer funds of this nature to the General Fund,by ordinance, once the County Treasurer certifies there is no longer a need for these funds to help service the related debt.The County Treasurer, Stacie Prada,has so certified—please see the attached memo. The attached proposed ordinance directs the inactivation of Fund 202—Road Improvement Bonds and Fund 602- 000-010—Road Improvement Guaranty Fund and directs that the cash in these funds be transferred to the General Fund. A public hearing notice for today's public hearing was published in the Port Townsend Leader twice—on January 12th and 19th,2022. FISCAL IMPACT: This request has no fiscal impact. Funds are simply moving from the fund they are currently in to the General Fund, $4,659.21 from Fund 202-000-030 and$5,000 from Fund 602-000-010. RECOMMENDATION: That the Board of County Commissioners take public testimony regarding the attached proposed ordinance, deliberate, and take action. FUND 202-000-030 —ROAD IMPROVEMENT } BOND FUND AND FUND 602-000-010 - } ROAD IMPROVEMENT GUARANTY FUND } WHEREAS, Jefferson County on January 22, 2001, through a unanimous vote of the Board of County Commissioners, created a Road Improvement Guaranty Fund, Fund 602-000-010; and WHEREAS, the Road Improvement Guaranty Fund, Fund 602-000-010, was created in conjunction with the creation of Road Improvement District(RID)No. 4; and WHEREAS, $5,000 was deposited into the fund so that if a property owner didn't make a required payment the County had a source of funds with which to make the payment and avoid a default on bonds sold to fund the related road improvements; and WHEREAS, the bonds related to the RID No. 4 road improvements have been retired eliminating the need for the Road Improvement Guaranty Fund; and WHEREAS, Road Improvement Bonds Fund, Fund 202-000-030 was created in conjunction with Road Improvement District No. 1 and related road improvement bond; and WHEREAS, this fund is no longer needed, either; and WHEREAS, funds of this nature, when no longer needed for their original purpose as certified by the County Treasurer, may be transferred to the General Fund(per RCW 35.54.095); and WHEREAS, the County Treasurer has so certified; NOW, THEREFORE, BE IT RESOLVED that the Jefferson County Board of Commissioners hereby directs the Jefferson County Auditor to inactivate Fund 202-000-030—Road Improvement Bonds and Fund 602-000-010—Road Improvement Guaranty Fund and further directs that the County Treasurer transfer the cash in both funds to the General Fund.
