Stone; and WHEREAS, the Jefferson County Hearing Examiner held a public hearing on the road vacation petition on September 21, 1999; and WHEREAS, the Jefferson County Hearing Examiner considered testimony of the public, comments from applicable departments, agencies and offices, and recommendation from the Jefferson County Public Works Department and Jefferson County Planning Department at the public hearing; and WHEREAS, the Jefferson County Hearing Examiner determined at the public hearing that the public will benefit from the vacation of this alley and such vacation complies with the Jefferson County Comprehensive Plan and other applicable plans, policies or ordinances; and WHEREAS, the Jefferson County Board of Commissioners considered said Hearing Examiner's report ofthe public hearing and his recommendation for the vacation request and hereby adopts the Findings of the Jefferson County Hearing Examiner dated October 4, 1999, NOW, lliEREFORE BE IT RESOLVED that the following be vacated and abandoned pursuant to RCW 36.87.140 and Jefferson County Road Vacation Ordinance No. 007-0809-99: The entire alley being approximately 12 feet in width and 200 feet in length adjacent to and coincident with Lots 1-9 and Lot 36 of Block 149 located in the Plat of Irondale Division No.6, recorded at Page 139, Volume 2 of Plats, records of Jefferson County, Washington. Chairman Harpole stated that ma.ximum square footage .may need to be increased in the final regulations on Accessary Dwelling Units (ADUs). \\larren Hart reported on a meeting of the Tn A.rea Community Club last week where the . provisional UGA designation was discussed, including the elements of the subarea workplan. Chairman Harpole listed several items he would like to discuss at the UGA workshop this \'leek: 1) transfer of lead to the Department of Community Development; 2) the procedures for bringing the studies to the Planning Commission and the JGMSC; 3) a short time line for the studies; 4) whether the subarea plans should be done simultaneously or if the areas should be prioritized; 5) what an advisory vote would cost; and 6) how to deal with the Comprehensive Plan amendment requests that are part of or adjacent to the subarea plan areas. Commissioner Humingford asked about the batch plant on the Dosewallips Bridge Project and Wan-en Han explained that Deputy Prosecuting Attorney David Alvarez is taking the lead on the correspondence \vith the State on this issue. PUBLIC WORKS \I"D. 1ê(( '\ Hearing Examiner's Recommendation re: Petition for Road Vacation; Portion of an Alley in the Plat of lrondale #6; "U!chael Anderson Representing 1).f. V. Stone, Applicant: Will Butterfield, Public Works Department, stated that this is a standard road vacation. The Hearing Examiner recommends approval of the vacation and Public Works staff concurs. Commissioner Huntingford moved to approve the vacation as presented. Chairman Harpole seconded the motion \'lhich carried. ,---L\ '\2.-, c..\-('-:- State Department of Ecology re: Regional Landfill Development Issues for J'yfunicipal Solid Waste Disposal: Richard Talbot, Public Works Department, introduced Laurie Davies, Cris Matthews and Wyn Hoffman from the Department of Ecology to answer questions on building a regional landfill on the Olympic Peninsula. Laurie Davies reviewed other projects in the State and noted that public interest or opposition can draw out the process. Cowlitz County expects a iYeaI process and Pierce County is almost done building their landfill. but it has taken 12 years. The Health Department issues the permit and DOE's role is to provide technical suppon. Cris Manhews explained mat the technical aspects of building a landfill are not difficult to overcome. Ho\vever, it is a very political issue. Chairman Harpole explained That Clallam County may be \villing to take pan in a regional effort because the Port Angeles landfill is scheduled to close in 2006. He asked that Public Works staff draft a letter to Clallam County for the Board's signature expressing interest in a regional landfill. The Gardiner Bridge reconstruction meeting \yill be held this v.leek. The options for opening the solid \vaste transfer station on Sunday 'will be revie\ved by the . SWAC this week. D. ../"'\C; n . Reqllestfor Reconsideration of Valuation re: Hearing Examiner's Recommendation , Petition for Road Vacation; Portion of an Alley in the Plat of lrondale #6; "Hichaet Anderson Representing ,"If. V. Stone.. Applicant: Michael Anderson, representing M. V. Stone, submitted a coITected letter. (See microfilmed document.) He revie\ved the compensation requirement of the road vacation ordinance and Mr. Stone's CUITem ta..'( statement. He advised that the Public Works .Department _asks the Assessor for an evaluation of the property w determine the value for the road vacation and he feels this is a re-evaluation of the property and is not appropriate to use to establish the value. Assessor Jack Westennan reponed that Mr. Stone ovmed 36 lots in one parcel. The first 8 lots on Prospect Avenue were valued at $ 1 ,500 each, with the balance of the lots being valued at $1 ,000 ~ach. He explained the other considerations used to determine the per lor value of the parcel. The ordinance states that the "assessed value" of the property is to be used to derennine value, but there is no assessed value for the properties in the vacation request (12' by 200' strip) because it doesn't have an assessed value until it is put on the tax roles and is assessed for taxes. The ordinance should say the appraised "cuITem markel:" value, F rank Gifford reponed that the ordinance allows the applicant to get an independent appraisal on the property if they feel the Assessor' 5 value is not COITect. An independent appraisal costs a minimum of $600. The majority of vacations are of a small value and if the ordinance \vording is changed to require the applicant to have an independem appraisal done the expense for the vacation will be increased. Jack Westerman noted that the applicant has to pay the COWlty for this property, and if the Assessor detennines the appraised value, the Coumy \vould also be detennining the value of the property. He recommends that J.n independent fee appraisal be done on road vacation applications. H~ noted that there was ::m cITor made by his Office in theproposed valuation of the strip of land that \vas vacated, Chainnan Harpole pointed out that the applicant has suggested that the value be 5330.00 (50% of the assessed value) and the Assessor's Office has suggested 5480 00, The issue is if the ordinance has been interpreted to me3.n the assessed val ue of the propeI1Y as it is tOday or \vhar is retlected on the ta..'( statement. Frank GiíIord also noted that the Department "\fill work on revisions to the ordinance. Discussion re: Options for Courthouse Basement Office Space (Old Planning Area): This discussion "vas postponed until November 15, 1999 during the Public Works Department agenda time. AGREEJJ1ENT SUPPLEiJ1ENT#4 re: Professional Services for TriArea/Glen Cove Special Study, RO1336; Extend Completion Date; Jefferson County Public Works; Shockey Brent: (Item 5 on the Consent Agenda) Commissioner Humingford moved to approve this supplemental agreement after Frank Gifford explained that this supplement is only to extend the time of the agree- ment, not to change the amount or scope of work. Chairman Harpole seconded the motion which carried. ~ \G Petition/or the Establishment of a Port Ludlow Drainage District: Commissioner Huntingford moved to find the signatures sufficient. accept the petition and to send a notice to the County Engineer to move fof\vard with the required recommendation. The Board asked that a time line for this work be developed and a discussion be held next week with the Department of Community Development and the Public Works Department regarding what department wìll take the lead. HEALTH & HU~IA~~ SERVICES . , Director's Update: The following items were discussed: The proposed fee schedules for Health, Environmental Health and A.nimal Services have been fof\varded to the Prosecuting Attorney's Office and the Board for publication and hearing. The County is required to hire an Alcohol and Drug Abuse Coordinator. The Substance Abuse Review Board "vill do the recruitment and the tìnal selection for this position. A 20 hour position "vill be adequate for this work. The Board needs to decide on 2 issues: 1) a possible payback of between S 1.000 and 55,000 from a contractor due to a billing oversight, and 2) who "vill have the supervisory Ciuthority over the Alcohol and Drug Abuse Coordinawr? Chainnan Harpole noted that 1-695 will have an impact on how this will be handled. .
