RESOLUTION NO. 42-99
WHEREAS, Jefferson County Board of Commissioners on April 5, 1999, called
for bids for the above mentioned supplies; and
WHEREAS, due notice of the call for bids was given as required by law; and
WHEREAS, only one potential bidder requested and obtained a bid packet; and
WHEREAS, one bid proposal sheet containing four separate bid items was
received and opened during public session for the week of April 26, 1999, as shown in the
attached bid tabulation; and
WHEREAS, the bidder indicated that the point of delivery for the Eastern
Jefferson County Asphalt Concrete would be the Lakeside Industries Cape George Plant; and
WHEREAS, according to Jefferson County's Critical Areas Code, the Cape
George Plant is located within a Critical Aquifer Recharge Area where asphalt manufacturing
operations may be prohibited; and
WHEREAS, Jefferson County's Mineral Lands Ordinance allows secondary
mineral processing activities such as asphalt batch plants only after obtaining a conditional use
pennit which would typically address adherence to environmental safeguards and standards of
operation; and
WHEREAS, Lakeside's Cape George Plant does not hold a conditional use
pennit; and
WHEREAS, special provisions associated with the call for bids reserved to the
County the right, among other things, to accept, modify, or reject submitted bids; and
WHEREAS, said Special Provisions also expressly reserved to the County the
right to reject bids based upon considerations of contractor compliance with all Federal, State, or
local laws, ordinances, rules, regulations, pennits and licenses; and

WHEREAS, substantial doubt exists at this time as to whether Lakeside's Cape
George Plant is operating in full compliance with all said local laws and regulations; and
WHEREAS, it is in the best interest of the people of Jefferson County to accept
the most responsive of the acceptable bids while awaiting the results of further investigation into
regulatory compliance issues at the Cape George Plant,
NOW THEREFORE, IT IS HEREBY RESOLVED that the bids submitted by
Lakeside Industries, Inc., for:
.
Asphalt Concrete Class B - Western Jefferson County, for
a Unit Bid price amount of $31.00 per ton; and
.
MC 250 Cold Mix - Eastern Jefferson County, for a Unit
bid price amount of $30.00 per ton; and
.
MC 250 Cold Mix - Western Jefferson County, for a Unit
Bid price amount of $30.00 per ton
are hereby accepted.
IT IS FURTHER RESOLVED THAT the bid submitted by Lakeside Industries,
Inc. for Asphalt Concrete Class B - Eastern Jefferson County, point of delivery Cape George
Plant, for a Unit Bid price amount of $26.00 per ton, is hereby rejected.
IT IS ALSO FURTHER RESOLVED, that the call for bids, bid specifications and
contract documents in their entirety as included in the bid package, and bid proposals are
incorporated by reference as part of this resolution.
