' -~, ::- - ~, :--' -' ,,_: "," , '"' -- -- --,,-, .'-,<-" ,,"c;,,:!:C:::' i/IA1~--" --"-:/-~....,.....-,-_,,,',l'-'" 429579 When recorded return to ----~&;;;-~r~Þr~~------ - --~- --- - -----------~ - STATE OF WASHINGTON COUNTY OF JEFFERSON -----,- _,n --- --',-'------ '-,,--,,- -- In the matter of x RESOLUTION NO, 101-99 Vacation of a Portion of Seattle Dr. Plat of Trail's End Homesites, Inc. x x WHEREAS, the Jefferson County Board of Commissioners has reviewed a road vacation petition submitted by Bruce Nordstrom; and WHEREAS, the Jefferson County Hearing Examiner held a public hearing on the road vacation petition on July 13, 1999; and WHEREAS, the Jefferson County Hearing Examiner considered testimony of the public, comments from applicable departments, agencies and offices, and recommendation from the Jefferson County Public Works Department and Jefferson County Planning Department at the public hearing; and WHEREAS, the Jefferson County Hearing Examiner detennined at the public hearing that the public will benefit from the vacation of this portion of Seattle Drive, and such vacation complies with the Jefferson County Comprehensive Plan and other applicable plans, policies or ordinances; and WHEREAS, the Jefferson County Board of Commissioners considered said Hearing Examiner's report of the public hearing and his recommendation for the vacation request and hereby adopts the Findings ofthe Jefferson County Hearing Examiner dated July 22, 1999; and WHEREAS, Jefferson County recognizes that the owners of properties adjacent to this portion of Seattle Drive may have relied upon Seattle Drive for ingress, egress and utilities in the purchase of their properties acquired with reference to the Plat of Trail's End Homesites, Inc. and, as such, have retained a private easement by operation of law over the vacated portion of Seattle Drive, such private right of way not being divested by the road vacation; and NOW, THEREFORE BE IT RESOLVED that the following be vacated and abandoned pursuant to RCW 36.87.140 and Jefferson County Road Vacation Ordinance No. 01-0102-96: A portion of platted Seattle Drive, south of Thorndyke Road, being approximately 30 feet wide and 420 feet in length lying easterly of, adjacent to, and contiguous with Govenunent Lot 1, Section 17, Township 27 North, Range 1 East, and, lying westerly of, adjacent to, and contiguous with Lots 6, 7, 8, 9, 10 of Block 5, a1110cated in the Plat of Trail's End Homesites, Inc., Vol. 3 of Plats, Page 30, records of Jefferson County, Washington.
