Resolution No. 103.....99
WHEREAS, the Jefferson County Board of Commissioners has reviewed a road vacation petition
submitted by Neil Cavette; and
WHEREAS, real property was dedicated to Jefferson County for road purposes in an instrument dated
April 24, 1889 and filed with the Jefferson County Auditor at Page 3, Volume 2 of Plats; and
WHEREAS, Jefferson County has not opened the following described right of way for public use for road
purposes within five (5) years of obtaining an interest in the real property for road purposes:
That portion of Ehn Street being approximately 60 feet in width and 360 feet in length, beginning at a point
adjoining the previously vacated portion of Ehn Street (3i4/96) Resolution No. 21-96, thence southerly
approximately 360 feet, adjacent to and coincident with Lots 5 and 6 of Block 76; to the easterly extension of
the southerly right of way limits of George Street; Also that portion of George Street being approximately 60
feet in width and approximately 450 feet in length adjacent to and coincident with Lots 6, 7, 8, 9 & 10 of
Block 76 and Lots 5 and 6 of Block 77, lying east of County Road; Also that portion of Maple Street being
approximately 60 feet in width and approximately 145 feet in length adjoining Lots 1 and 10 of Block 76 and
Lot 6 of Block 77 (lying easterly of Cook Ave. Ext); Also, that portion of Catherine Street, previously not
vacated per said Resolution No. 21-96, being approximately 30 feet in width and approximately 165 feet in
length adjoining to Lots 3, 4 & 5 of Block 76 (lying easterly of Cook Ave. Ext), together with the alley in
block 76 being approximately 16 feet in width; all located in the Plat of Tibbals Lake Park, Volume 2, Page 3
of Plats, Section 4, Township 30 North, Range I West, Jefferson County, Washington.
WHEREAS, the above-described road was vacated by operation of law and the County divested of its
interest before the 1909 amendment, Laws of 1909, Chapter 90, Section 1, became effective, which exempted from
vacation by operation of law certain lands dedicated for road purposes; and
WHEREAS, the Jefferson County Board of Commissioners desires to remove this cloud on title to the real
property;
NOW, THEREFORE BE IT RESOLVED that the dedicated platted road more particularly described above
has been vacated by operation of law and Jefferson County asserts no claim of interest for public road purposes in
them. Utility rights, private easements, or other rights or interests may still exist.
