As of January 24, 2022, DCD has not received the required additional information. It was required for you to submit the following information: Pre‐Application Conference Application with the Jefferson County Department of Community Development (DCD). Jefferson County Code (JCC) 18.40.310(1): “A land use application shall be null and void if the applicant fails to submit the requested additional information under JCC 18.40.110, within 180 days from the department’s request or within a time period as specified by the hearing examiner. Applications pending as of October 1, 2019, shall have 180 days to provide the requested additional information prior to expiring under this section, unless the administrator grants an extension under subsection (2) of this section. Land use applications expired under this section shall forfeit all application fees.” Please provide the additional information to DCD no later than February 23, 2022 [180 days from the email sent on August 27, 2021]. If the requested information is not received by February 23, 2022 your application will expire, resulting in your application being null and void. If you need additional time to comply with the request for additional information beyond February 23, 2022, please submit a written extension request to DCD for consideration. Per JCC 18.40.310, the Unified Development Code Administrator may grant a one-time 180-day extension. Please see JCC 18.40.310 for guidelines on when the Administrator may grant a one-time extension. If an extension is not granted or you do not submit the requested additional information by February 23, 2022, your application will be null and void without further notice. All application fees will be forfeited. However, the new property owners posted an Air B&B advertisement that states the residence presently has 3 bedrooms and accommodates 10 guests. All renting uses must stop until an approved Transient Rental Permit is issued. o HISTORY: The current property owners have rented their residence in the past, and may still be renting the residence as a Hospitality Establishment- Short Term Transient Rental (30 days). The compliant statement said that the residence is currently being used as a vacation rental without required permits. Review of the property records confirm that no Transient Rental permit has been approved. As the property owner, you are responsible for the above-mentioned activity. Until permits for all listed violations are obtained, the applicant must STOP all hospitality establishment renting activities on the property. Code Compliance would prefer to resolve this matter cooperatively and is providing you an opportunity to voluntarily comply. Code Violations that are not corrected within 30 days of this letter can result in further enforcement action. Please complete the following to correct these violations: Schedule a CAM conference with the Planning Department to discuss the steps to obtain a conditional use permit to allow for commercial camping, and; Apply and obtain any required permits determined during CAM Conference, and; Complete any required inspections and mitigation determined during permit process. Increasing the number of bedroom of the home and septic system from the originally permitted one bedroom to two or more bedrooms will require a septic system that is in compliance with the current on- site sewage code. This includes the minimum land area requirements. Properties served by an on-site well require one acre of land to meet the on-site sewage code. Waivers from the one acre may be obtained down to a minimum ½ acre. This property is less than ½ acre in size so a waiver is not a possibility. As a result EPH could not sign off on any building permit that results in more than the originally permitted one bedroom. EPH could sign off on a building permit that does not result in additional bedrooms if the following items were met: The existing drain field laterals were exposed and the entire system is found to be installed as permitted in 1976.
