Existing Facilities
Jefferson County Sportsmen’s Association (JCSA) is hereby granted a permit to operate this pre-existing Commercial Shooting Facility (the “Facility”), including a pistol range, a 50-yard
rifle range, 100-yard rifle range, 200/300-yard rifle range, trap range, and archery range.
Compliance with Documents Incorporated by Reference and Other Applicable Requirements.
This permit includes the following Appendices:
Appendix A - Facility Design Plan, Safety Plan, Operations Plan, Environmental Plan, and Noise Abatement Plan
Appendix B - Best Management Practices for Lead at Outdoor Shooting Ranges, USEPA Region 2, 2005
Appendix C - License and Operating Agreement between Jefferson County, WA and JCSA, June 17, 2019;
Appendix D – Inspection Checklist
The Facility shall be operated in conformance with the provisions in this permit and its Appendices;
Jefferson County Code (JCC) 8.50; and, applicable local, State and Federal requirements.
Hours of Operation
Saturday - Sunday: 10:00 am – 5:00 pm or sunset (whichever is earlier)
Monday: Closed to shooting of firearms
Tuesday - Friday: 10:00 am - 7:00 pm or sunset (whichever is earlier)
Last Sunday of each Month: Closed to shooting of firearms
Organized law enforcement training will be scheduled in advance.
High intensity shooting and events will be noticed to the public on JCSA’s website. The JCSA will also establish and employ a method for proactively notifying the public such as social
media, email lists, or by posting notices in the Port Townsend Leader and/or the Peninsula Daily News. Notices should be made within two weeks of setting the date, and no less that
seven days before the event.
Shooting after dark shall only occur for law enforcement training purposes. It shall not occur past 10:00 pm (standard time). Pre-notification of these training sessions shall be given
to JeffCom, so that they will be informed should community members call.
Early events: Up to 8 per year are authorized. Early events can begin at 8:00 am. Pre-notification shall be given to JeffCom, so that they will be informed should community members call.
These hours may be modified upon mutual written agreement executed by both parties and amendment of the License and Operating Agreement between Jefferson County, WA and JCSA dated June
17, 2019.
Unauthorized Entry
The Facility shall be operated to deter unauthorized entry to any shooting range; shall be operated so that when firearms are operating there is containment, thereby minimizing threatened
harm; and, shall not create a public nuisance.
Insurance
JCSA shall maintain comprehensive general liability insurance coverage, with a minimum coverage amount of $1,000,000 for each occurrence and combined single limit and $2,000,000 in the
aggregate during operation of the Facility. Certificates of insurance for all policies that provide insurance coverage for the Facility shall be provided to the Department evidencing
continuous insurance coverage required by the operations component within 15 days of approval of the operations permit that include:
(i) The limits of coverage;
(ii) The names and addresses of all certificate holders; and
(iii) A statement that the insurance policy shall not be canceled or allowed to expire except on 30 days’ prior written notice to the Department; and,
(i) A requirement that the Department be notified of any change in the insurance required by the operations component.
Environmental Stewardship
JCSA must implement BMPs for the collection and disposal of bullets, cartridges, and shotgun wadding, and BMPs for lead as recommended by USEPA Region 2 in its 2005 publication entitled
Best Management Practices for Lead at Outdoor Shooting Ranges, as it exists now or later is amended.
In Best Management Practices for Lead at Outdoor Shooting Ranges, EPA recommends that ranges prepare an Environmental Stewardship Plan. As part of the application submittal for this
permit, JCSA provided the Environmental Stewardship Plan (the “Plan”) prepared by URS Corporation in March 2015 (in Appendix A). JCSA shall implement best management practices (BMPs)
described in the Plan, including:
(i) Establishing and maintaining full vegetative cover to prevent soil erosion;
(ii) Soil pH monitoring;
(iii) Bullet impact berm inspection;
(iv) Recording lead removal performed by club members; and,
(v) Posting signs to encourage proper hygiene.
JCSA shall maintain records of annual soil pH monitoring, annual inspections of bullet accumulation at bullet impact berms of all ranges, and lead recycling performed by club members
at all ranges on forms included in the Plan for the life of the shooting range and 10 years after closing. The records shall be provided to Jefferson County Public Health (JCPH, or
the “Department”) upon request, and shall be included in each annual report.
Annual Report
JCSA shall submit an annual report to the JCPH Environmental Health Director (the “Director”). The annual report shall be due each year on the last day of the same month the operating
permit was issued, and shall include:
(i) A written statement by the operator of the Facility declaring that the Facility is compliant with the initial operating permit approval;
(ii) A statement of any changes to the Facility Design, Safety, Operations, Environmental, and/or Noise Abatement Plans (Appendix A); and
(iii) A current statement of general liability insurance; and,
(iv) Records of annual soil pH monitoring, annual inspections of bullet accumulation at bullet impact berms of all ranges, and lead recycling performed by club members at all ranges
on forms included in the Environmental Stewardship Plan prepared by URS Corporation in March 2015 (in Appendix A).
Annual Inspection
Following submission of the annual report the Facility shall be subject to an annual inspection by JCPH, using the attached inspection checklist (Appendix D), which shall be effective
during the term of this operating permit. During the annual inspection, all reports of violation shall be addressed by the Department and JCSA.
Following inspection, the Department shall inform the owner or operator in writing of any deficiencies or corrective actions to be taken. The Director may suspend or modify the operating
permit, close the
Facility, or modify shooting range operations. The owner or operator shall take corrective action within a reasonable time, as determined by the Department in consultation with the operator,
and shall allow the Department to conduct follow-up inspections to verify that corrective action has been taken. The Department shall verify that corrective action has been taken; and
until the corrective measures are completed and verified, the Director’s determination shall remain in effect.
JSCA shall reimburse the county annually for the actual cost of administering and performing the annual inspection.
Noncompliance Inspection
A noncompliance inspection shall be triggered upon receipt by the Director of any claim of noncompliance with the operating permit, or any claim that there exists either a life safety
incident or threatened harm. For noncompliance inspections, the Department shall have the authority to establish procedures for noncompliance inspections. The Department shall contact
the Facility within one business day after receipt by the Department of a claim pursuant to this section and shall give the commercial shooting facility a written notice of the claim;
and the owner or operator shall make the Facility available for inspection not later than two business days after receiving a request for an inspection from the Department.
Following inspection, the Department shall inform the owner or operator in writing of any deficiencies or corrective actions to be taken. The Director may suspend or modify the operating
permit, close the commercial shooting facility or a shooting range, or modify shooting range operations. The owner or operator shall take corrective action within a reasonable time,
as determined by the Department in consultation with the operator, and shall allow the Department to conduct follow-up inspections to verify that corrective action has been taken. The
Department shall verify that corrective action has been taken; and until the corrective measures are completed and verified, the Director’s determination shall remain in effect.
Life Safety Incident
If the Director determines there was a life safety incident, the Director may suspend or modify the operating permit, close the commercial shooting facility or a shooting range, or modify
shooting range operations. The Director shall provide the owner or operator a written notice that shall set forth each claimed life safety incident with a specific reference to applicable
violation of this article or operating permit and the corrective measures to be taken. The owner or operator shall respond in writing to the written notice provided by the Director
and shall take any necessary corrective measures within a reasonable time, as determined by the Department in consultation with the operator. The owner or operator shall allow the Department
to conduct follow-up inspections to verify that corrective action has been taken. The Department shall verify that corrective action has been taken; and until the corrective measures
are completed and verified, the Director’s determination shall remain in effect.
Suspension of Operating Permit
An operating permit that has been suspended requires the commercial shooting facility to cease any firing activities until the permit has been reinstated by the Director.
Administrative Remedy for Decisions Made by the Director
The Director may suspend or modify the operating permit, close the commercial shooting facility or a shooting range, or modify shooting range operations in conformance with JCC 8.50.
The decision may be appealed to the hearing examiner pursuant to the procedures in JCC 2.30 by providing written notice of appeal to the Director within 14 calendar days of the decision.
The fee for such appeal shall be as set forth in the Jefferson County fee ordinance and must be paid by the appellant at the time of filing the notice of appeal.
Expansion
Any expansion, as defined in JCC 8.50.220(16), of a commercial shooting facility shall require a new operating permit.
Non-Transferability
This permit is not transferable.
