Pomona Woods Type III Conditional Use Application hearing on March 17, 2022.

There is a 3 season stream that runs from the higher areas along the north side of our property. A large parking lot up
above could greatly accelerate land loss and erosion on my property.

These are some photos of the precarious geographical features located on our property close to the property lines. This
is during a relatively dry period. There is a large area where the ground has dropped a foot because of water running
underneath from the higher elevations. I can only imagine what would happen if there was a parking lot almost directly
above this area. Who would be responsible for increased water flow and ensuing damage to my property?

I would like to take this opportunity to state, and put on the record, my many ongoing concerns
about this proposed development. I would first like to point out that the purported size of the structure
has been described as various sizes from 6,000 to 12,000 square feet. What is actually the approved
size?
In the County’s report they differentiated between the Old Alcohol Plant and Pomona Woods by
stating that the Old Alcohol Plant is a “large scale operation.” I find this very misleading as Pomona
Woods has proposed 24 sleeping rooms in addition to a caretaker’s cottage, while The Old Alcohol Plant
has 18.
As stated in the Commissioner’s response to concerns about storm water runoff, “The applicant is not
liable for geological hazardous areas on other properties…unless the proposed development would
impact the erosion or instability of adjacent geological features of the landscape.” I have sent pictures
addressing our grave concerns regarding the instability of the ground on the northern side of our
property and heavy water flow running down from higher elevations on the 2 properties to this site. The
applicant is proposing a large parking lot fifty feet over and above this sensitive area. There will also be
construction of a caretakers cottage above and over 87 feet from the property lines. Since Ann had a
parking area put in at the bottom of the driveway, there has been an excess of water pooled there.
Shold commented that he wasn’t able to provide a turn around due to said water.
Provisions for noise and light pollution protections to adjoining properties are nonexistent. Just
because you decide that it won’t be a problem doesn’t mean it has any basis in fact. I feel that these
concerns were readily dismissed and that the neighbors’ existing lifestyles were not taken into
consideration. How can you allow building in a quiet forest from 7 am until 10pm and pretend that
you’re giving any consideration to existing neighbors and their lifestyles? How can you have daily
outdoor activities and nightly campfires feet from our property without any loss of expectation of
continuing quality of life?Another factor of this is the economic impact on Oak Bay Residents
investments.
The statement that “the public interest suffers no detrimental effects,” is ludicrous. This proposed
development will greatly detract from the quality of life homebuyers were led to expect when
purchasing their properties. As Jefferson County development considerations state: “There is an
expectation that owners of residential property have a right to the peaceful enjoyment of their
property.” How can they possibly assure me that these very rights aren’t being violated with a constant
flow of strangers enjoying outdoor activities from 8am to 10pm daily, especially considering the nature
of her proposed activities and the close proximity of these activities to our home?

“The condition use has merit and value for the community as a whole.” This determination by the
Planning Commission is absolutely ludicrous. First off, you have over 150 residents writing letters and
stating that it is negatively impacting them in some way and who do not believe it has any value or
merit. Ann is planning on offering a paltry 7 jobs for this community. People will not be spending their
money to enrich the community as they will be staying and eating at PW. How did they reach the
determination of merit and value? The one and only person benefitting from this proposition is Ann
Burkhart. There is little chance that her venture will substantially add to the community coffers. How
exactly has she demonstrated any contribution to the community?
The probability of this project’s success is infinitesimally low. Who in the world will be attracted to a
facility where you stay in cell like rooms and have virtually nothing to do? Her proposed activities are
laughable: Stargazing? Small campfires? Hiking? Field trips? Especially since the lower two thirds of her
property are virtually impassable. How many companies are actually having group retreats anymore?
Most corporations are having people work from home and are very unlikely to arrange group retreats in
the distant future.When this project starts floundering, will there be additional provisions for her to
book single reservations instead of groups? When the project fails altogether, how readily will the
planning committee adapt the permit to an even less desirable use? What recourse do I have when my
land is negatively affected by increased runoff and erosion? Who will assess this risk and give a
determination that our land will not be negatively affected? Who will assume monetary responsibility
when and if this construction has adverse effects? These are all very valid and likely scenarios. The
surrounding neighbors and residents of Port Hadlock are left to feel that we have no say or control in
protecting our primary investment and the peaceful environment we were led to expect when we
purchased in this area. I guess it’s growth at any cost, even for unlikely business ventures. George and

I was very disconcerted when I received an email from Ann Burkhart stating that PUD
was going to be surveying Oak Bay Road from Port Hadlock to bring public water to her
property. I’m sure the general public would be very interested in how this is even
possible. Who is incurring this expense and to what purpose?? It seems to me she’s
been given some kind of assurances that her project will go through, otherwise what’s in
it for PUD when they never indicated they were planning on this extension? The
concerned citizens of this area continue to be outraged by this proposed destruction of
our zones rural, unspoiled environment. A 12,000 square foot commercial enterprise
yards from my home is not what I was led to expect when we purchased this property.
The one and only person who is benefiting from this proposal is Ann Burkhart, who isn’t
even a Jefferson County resident. All of us deserve to know what is going on because it
sure seems like there’s a lot of progression without an actual decision.
