NOTICE OF PUBLIC HEARING
PROPOSED AMENDMENT TO ORDINANCE NO. 2-77
JEFFERSON COUNTY HEALTH DEPARTMENT
RULES AND REGULATIONS
NOTICE IS HEREBY GIVEN that the Jefferson County Board
of Commissioners will conduct a public hearing at the hour of
11:30 a.m. on Monday Janaury 7, 1985 in the Commissioners' Chambers,
County Courthouse, Port Townsend, Washington for the purpose
of obtaining comments of all interested persons on the proposed
changes to Ordinance No. 2-77, Jefferson County Health Department
Rules and Regulations. The proposed amendments are as follows.

RULES AND REGULATIONS
OF PUBLIC FOOD SERVICE ESTABLISHMENTS
AN ORDINANCE relating to the sanitation and health require-
ments of public food service establishment as defined in the "Rules
and Regulations of the State Board of Health, Food Service Sanitation"
and the United States Public Health Service "Food Service Sanitation
Manual"~ tiE governing of solid waste handling and implementing the
comprehensive solid waste management plan covering storage, collections,
transportation, treatment, utilization, processing and final disposal:
providing for the regulation of on-site sewage disposal systems, the
licensing of commercial installers, providing for on-site management
systems, providing for establishing standards for equipment and operation
of septic tank pumpers~ establishing permit fees, the issuance and
revocation of permits, the payment of permit fees and prescribing penalties
for violations thereof.

RULES AND REGULATIONS RELATING TO THE SANITATION AND HEALTH OF PUBLIC
FOOD SERVICE ESTABLISHMENTS AS DEFINED IN THE "RULES AND REGULATIONS
OF THE STATE BOARD OF HEALTH FOOD SERVICE SANITATION", AS ADOPTED
ON OCTOBER 1, 1980, AND AS DEFINED IN THE 1976 EDITION OF THE UNITED
STATES PUBLIC HEALTH SERVICE"FOOD SERVICE SANITATION MANUAL", RELATING
TO THE ISSUANCE AND REVOCATION OF PERMITS THE PAYMENT OF PERMIT FEES,
AND PRESCRIBING PENALTIES FOR VIOLATIONS THEREOF.
WHEREAS, under the provision of R.C.W. 70.05.060 and R.C.W.
70.46.060, the Board of Health is charged with the duty of making
such rules and regulations as may be necessary for the prevention,
suppression and control of dangerous, contagious or infectious disease
and
WHEREAS, the following rules and regulations are necessary
for the prevention suppression and control of dangerous, contagious
or infectious disease, now, therefore,
BE IT RESOLVED by the Jefferson County Board of Commissioners
that the following be adopted as regulations.
SECTION I
1.1 The State Board of Health Rules and Regulations, Food Service
Sanitation, as adopted October 1, 1980 is hereby adopted by reference
as the Rules and Regulations governing Food Service Sanitation in
Jefferson County and including subsequent amendments thereto.
1.2 The 1976 Edition of the United States Public Health Service Food
Service Sanitation Manual is hereby adopted by reference as the official
interpretation of this ordinance, where applicable.
1.3 Where a conflict may occur between this ordtnance and the State
Board of Health Regulations, or the PHS Food Service Sanitation Manual,
the Jefferson County Health Department Regulations take preference,
with the State Board of Health Regulations second preference and the
PHS Sanitation Manual third.
SECTION II
2.1 Permits: A valid permit issued by the Health Office shall be
required for any person to operate a food service establishment within
the jurisdiction of the Jefferson County Health Department. Only
persons who comply with the minimum requirements of these regulations
shall be entitled to receive and retain such a permit. Permits shall
not be transferable from one person to another or place other than
that specified on the permit. A valid permit shall be posted in a
conspicuous place in every food establishment. Application for a
temporary food service establishment permit shall be made no later
than ten (10) days prior to the first scheduled date._of~peration.
Permits issued for temporary food s~rvice establishments shall not
exceed a p~riod of fourteen (14) days.

2.2 Permit Application: A written application for a Permit shall
be made on forms provided by the Health Officer. Such application
shall include the name or names of the applicant and whether such
application is for an individual firm, corporation or partnership.
The application shall include location of operation and type of food
service proposed and any other information requested on the form to
help evaluate the proposal. Applications for temporary food service
establishments shall include the inclusive datæof the proposed operation,
location and proposed menu items.

2.6 Permit Suspension Appeal: Whenever a food service establishment
operator feels agrieved by the decision made by the Health Officer
following a hearing, he may within five (5) days file a written notice
of appeal with the Jefferson County Board of Health.
SECTION III
3.1 Inspection Records: The Health Officer shall cause to be made
inspections of all Food Service Establishments at least annually,
or at frequent enough intervals to assure compliance with these Rules
and Regulations. Upon completion of the inspection the demerit values
of all violations shall be totaled and the establishment notified
in writing on the inspection forms in use.
3.1a Demerit values shall be the weighted Hazard Point Values on the
Food Service Establishment Inspection Report form designated as form
DSHS 9-106.
3.2 Hazard Point Scores:

3.2a When the hazard point total is 74 or less all violations of
Blue items must be corrected by the next regular insp~~~io~ and all
Red items must be corrected immediately. When the hazard point total
is at least 75 but not greater than 100 or wh~n there are 50 or more
Red item points, all Red items must be corrected immediately and the
Blue items must be corrected within thirty (30) days. At that time
the establishment shall be reins cted and the oper tor shall pay
the Health Department the reinspection fee as set f rth in the Jefferson
Coun~y Health Department fee schedule.
3.2b Whe~ the Hazard point total exceeds 74 Red items or exceeds
100 total ite~s, the establishment's Food Service Permit is subject
to immediate suspension and closure of the establishment by the Director
of Environmental Health or the County Health Officer, if, in the opinion
of the inspecting officer, an immediate health hazard exists or if
the establishment has on reco~d a hazard point total of 40 or more
on the last previous inspe~tio~

3.2c In the case of temporfry food service establishments, violations
must be corrected within a specified period of time not to exceed
24 hours. All Red items shall be corrected immediately. Failure
to comply with such notice shall result in_,immediate suspension_~£

SECTION IV
4.1 Additional Provisions: In addition to those requirements set
forth by the State Board of Health Rules and Regulations and the interpre-
tation by the U.S. Public Health Service Food Service Sanitation Manual
1976 Edition, the following stipulation shall also be met.
No further proposed changes in Ordinance.
This ordinance shall become effective January ~, 1985.
