HomeMy WebLinkAbout042522ca09 DRAFT ,„,„;\ MINUTE S Regular Meeting — April 18, 2022, 9:00 a.m. Jefferson County Courthouse — Commissioners' Chambers 1820 Jefferson Street, Port Townsend, WA CALL TO ORDER: Chair Heidi Eisenhour, Commissioner Kate Dean and Commissioner Greg Brotherton were present. Chair Eisenhour called the meeting to order at the appointed time. PUBLIC COMMENT PERIOD: The following is a summary of comments made by individuals in attendance at the meeting and reflect their personal opinions: • Comment regarding water quality impacting shellfish farming in Jefferson County. The Commissioners responded to the one comment received. • Comment regarding balancing the environment and Junior Taxing Districts. • Comment regarding No Shoot Area petitions, and a recent State Auditor's report involving Jefferson County. The Commissioners and County Administrator addressed the additional comments received. APPROVAL AND ADOPTION OF THE CONSENT AGENDA: As Consent Agenda Item No. 4 re: School Based Mental Health Services attachment was not working, Commissioner Brotherton moved to remove that item from the Consent Agenda and approve the remaining items as presented. Commissioner Dean seconded the motion which carried by a unanimous vote. 1. AGREEMENT re: Shoreline User Guide to Provide Information Regarding Shoreline Regulations; In the Amount of$25,150; Jefferson County Department of Community Development; Washington State Department of Ecology (DOE) 2. AGREEMENT re: Nurse Family Partnership Supervisor; In the Amount not to Exceed $50,000; Jefferson County Public Health; Kitsap Public Health District 3. AGREEMENT,Amendment No.3 re: 2022-2024 Consolidated Contracts; Additional Amount of$5,600 for a Project Total of$2,561,370; Jefferson County Public Health; Washington State Department of Health(DOH) 4. AGREEMENT,Amendment No. 1 re: School Based Mental Health Services; Amends Original Sales Tax Revenue Amount in the Decreased Amount of$199,138 ($93,368 in 2021/2022 & $105,770 in 2022/2023); Jefferson County Public Health; Olympic Educational School District (OESD)No. 114 (Removed and approved later in the meeting) 1 DRAFT Commissioners Meeting Minutes of April 18, 2022 5. MINUTES re: Regular Meeting of April 11, 2022 9. Payment of Jefferson County Payroll Warrants Dated April 5, 2022 Totaling $1,116,750.08 and A/P Warrants Done by Payroll Dated April 5, 2022 Totaling $563,151.84; Dated April 5, 2022 Totaling $401,723.81; Dated April 5, 2022 Totaling $1,635.50 and Dated April 12, 2022 Totaling $10,222.47 (Records of all claims submitted for payment along with A/P Warrants approved by the Payroll Services Manager are retained in the Jefferson County Auditor's Office) 10. Payment of Jefferson County Vouchers/Warrants Dated April 11, 2022 Totaling $1,288,658.14 (Records of all claims submitted for payment along with vouchers approved and signed by the Board of Jefferson County Commissioners are retained by the Jefferson County Auditor and Public Works Department.) PROCLAMATION re: Declaring April 22,2022 as International Earth Day: All three Commissioners read aloud the proclamation. Commissioner Dean moved to approve the PROCLAMATION Declaring April 22, 2022 as International Earth Day. Commissioner Brotherton seconded the motion which carried by a unanimous vote. PROCLAMATION re: Declaring the Week of April 16-24,2022 as National Park Week: After all three Commissioners read aloud the proclamation, Commissioner Dean moved to approve the PROCLAMATION Declaring the Week of April 16-24, 2022 as National Park Week. Commissioner Brotherton seconded the motion which carried by a unanimous vote. DISCUSSION re: AGREEMENT re: School Based Mental Health Services (Consent Agenda Item No. 4): The Commissioners and County Administrator received via email the School Based Mental Health Services document that failed to open earlier and reviewed it with the public. As the Board had questions about the contract, Public Health Deputy Director Veronica Shaw was consulted during the meeting to address those questions. After review, Commissioner Dean moved to approve AGREEMENT, Amendment No. 1 re: School Based Mental Health Services; Amends Original Sales Tax Revenue Amount in the Decreased Amount of$199,138 ($93,368 in 2021/2022 & $105,770 in 2022/2023); Jefferson County Public Health; Olympic Educational School District(OESD) No. 114. WEEKLY UPDATE re: COVID-19: Public Health Officer Dr. Allison Berry provided information on the COVID-19 virus in Jefferson County and Emergency Management Director Willie Bence provided a situation report. The meeting was recessed at 10:25 a.m. and reconvened at 10:31 a.m. with all three Commissioners present. 2 Commissioners Meeting Minutes of April 18, 2022 n, HEARING re: First Quarter 2022 Budget Appropriations/Extensions; Various County Departments: County Administrator Mark McCauley reviewed the various budget appropriations/extensions with the Board and the public in attendance. Due to technical issues, the budget presentation had to be restarted. Mr. McCauley noted that the Clerk's budget appropriation indicated a revenue of$45,300, but failed to include $45,299.57 in the expenditure line. He noted that if approved, the resolution will need to reflect that change for the Clerk's Office, and that would affect the expenditure total as well. He continued reviewing the remaining budget requests. Chair Eisenhour opened the hearing to allow for public testimony. The following individual provided testimony: Tom Thiersch. Hearing no further testimony, Chair Eisenhour closed the public hearing. During hearing testimony, Mr. Thiersch voiced concern regarding the Economic Development Council (EDC) Team Jefferson's lack of invoice submittals for 3rd and 4th Quarter 2021 which resulted in a need for a budget appropriation in 2022. Clerk Gallaway responded to Mr. Thiersch's concern by stating that she had asked previous Director Brian Kuh for 3rd and 4th Quarter 2021 invoices for the Public Infrastructure Fund and the Community Services Fund but at that time, he was under the impression that since the new 5-Way Agreement was approved, those contracts ended. In reviewing the contracts with the County Administrator, it was determined EDC should have billed for those quarters in 2021. The new EDC Director was asked to invoice the County for the missing invoices. Commissioner Dean moved to approve RESOLUTION NO. 20-22 re: First Quarter 2022 Budget Appropriations and Extensions for Various County Departments, with the exception of offsetting expenditure authority for the Clerk's Office in the amount of$45,299.57. Commissioner Brotherton seconded the motion which carried by a unanimous vote. DISCUSSION re: Potentially Establishing No Shooting Areas Under Chapter 8.50 of the Jefferson County Code: Chief Civil Deputy Prosecuting Attorney Philip Hunsucker provided a presentation and reviewed the maps of three proposed No Shooting Areas (NSA) with the Board: Smaller Cape George NSA, Larger Cape George NSA and Gardiner Beach NSA. He noted that the Commissioners have three options in moving forward: 1) Hold a public hearing regarding the petition; 2) Choose to facilitate an amicable solution within the proposed area; or 3) Assign a review committee to consider the merit of the petition specific to the area under consideration. The Commissioners agreed to schedule a virtual evening Special Meeting to address these issues with the local Tribes and the public. ADDITIONAL BUSINESS: Letter re: Rural Tourism Support Program Grant Committee: Commissioner Brotherton shared a draft letter with the Board regarding Jefferson County Chamber of Commerce's request for a letter of support for their Rural Tourism Support(RTS) program application. He stated the Chambers requested to receive the letter right away. After discussion, Commissioner Brotherton moved to send the letter as shared to support the grant application by the Chamber of Commerce. Commissioner Dean seconded the motion which carried by a unanimous vote. Staff will email the fully executed letter to Jefferson County Chamber of Commerce Executive Director Arlene Alen during the recess. 3 Commissioners Meeting Minutes of April 18, 2022 ED A F T The meeting was recessed at 12:00 p.m. and reconvened at 1:32 p.m. with all three Commissioners present. EXECUTIVE SESSION: An Executive Session was scheduled from 1:30 p.m. to 2:00 p.m. Chair Eisenhour announced that the Executive Session will be held from 1:33 p.m. to 2:03 p.m. regarding Attorney-Client Privilege, Potential Litigation under exemption RCW 42.30.110(1)(i) as outlined in the Open Public Meetings Act. Staff present: County Administrator, Chief Civil Deputy Prosecuting Attorney, Deputy Prosecuting Attorney III and Department of Community Development Director. The Board resumed the regular meeting at 2:06 p.m. Chair Eisenhour announced that the Board will be extending the Executive Session from 2:07 p.m. to 2:27 p.m. The Board resumed the regular meeting at 2:29 p.m. Chair Eisenhour announced that the Board will be extending the Executive Session from 2:30 p.m. to 2:40 p.m. The Board concluded the Executive Session and resumed the regular meeting at 2:41 p.m. EXECUTIVE SESSION: An Executive Session was scheduled from 2:00 p.m. to 2:10 p.m. Chair Eisenhour announced that the Executive Session will be held from 2:42 p.m. to 2:52 p.m. regarding Attorney-Client Privilege, Actual Litigation under exemption RCW 42.30.110(1)(i) as outlined in the Open Public Meetings Act. Staff present: County Administrator and Chief Civil Deputy Prosecuting Attorney. The Board concluded the Executive Session and resumed the regular meeting at 2:52 p.m. CONTINUED DISCUSSION re: Site Control of the Caswell-Brown Village Phase 2A: Department of Community Development(DCD) Director Brent Butler, Olympic Community Action Program (OlyCAP) Executive Director Cherish Cronmiller and OlyCAP Director of Housing and Community Development were present to discuss site control of the Caswell-Brown Village Phase 2A. DCD Director Butler reviewed the options for moving forward with the Board. After discussion, Commissioner Brotherton moved to authorize the County Administrator to negotiate a lease with possible purchase option with OlyCAP for the Caswell-Brown Village property on Mill Road. Commissioner Dean seconded the motion which carried by a unanimous vote. WORKSHOP re: County Infrastructure and Capital Needs: Commissioner Dean reviewed the County's infrastructure and capital needs in preparation for the May 19, 2022 Intergovernmental Collaborative Group (ICG)meeting. Public Works Director/County Engineer Monte Reinders and Public Works Assistant Director Eric Kuzma were present to discuss Public Works projects. Jefferson County Commissioner/Chair Heidi Eisenhour and Commissioner Kate Dean and many other Commissioners and County Officials across Washington State were in attendance. DISCUSSION with Other Washington State Counties and Washington State Association of Counties (WSAC) Staff: The participants of the meeting discussed various County issues.
