The appellants assert the true and fair market value of the property to be $310,381 ($176,746 for the land and $133,335 for the improvements). The Assessor's valuation of the property as of January 1, 2021 is $455,864 ($260,561 for the land and $195,303 for the improvements). Appellants'Arguments and Evidence:The appellants assert that the subject property was assessed 60% higher than comparable properties and their estimate was based upon the average of the comparable properties. The appellants did not list any comparable property sales. Assessor's Arguments and Evidence: The Assessor's representative presented current sales data from two other properties on Oak Bay Road. One was purchased in 2021 for $800,000 and was $101,000 over list price. Comparable #2 was purchased for$905,000, also in 2021 and was $206,000 over list. The Assessor's representative also told the BOE that the subject property was purchased in 2005 for$420,000 and had substantial improvements to the property since the purchase. Most noticeably stairs to the beach. The Assessor's representative also warned the Appellant that it was likely that this property would see a substantial increase in assessment value because of the nearby sales. Decision:After thoughtful consideration the Board finds that the appellants did not present the clear, cogent, and convincing evidence necessary to overcome the presumptive correctness of the value established by the Assessor. The Board of Equalization sustains the value established by the Assessor.
