COVER LETTER for No Shooting Area Petition
Because "there is a reasonable likelihood that humans, domestic animals, or property may be jeopardized" if
firearms are discharged within this area, we the undersigned, in accordance with RCW 9.41.300, request a No
Shoot Area be established in Gardiner described as follows:
• from the Port Townsend Boat Launch on the west
• to the Nebel Road on the east and
• from the Jefferson County line on the north
• to the high tide water line of the lagoon and wetlands on the south.
Reason for petition:
The general public and Gardiner residents use this area on a daily basis for various purposes.
• Launching boats—fishing, crabbing, sailing, kyacking
• Beaching— picnics, treasure collection, photography, daydreaming
• Exercise—dog walking, bird watching, private meditation
• Parking —visiting neighbors, lunch breaks, romantic rendezvous
• Natural habitats—Canadian geese, mallard ducks, Great Blue Herons, bald eagles and more
Incident:
Since Gardiner Beach has easy access from Hwy 101, accessible parking and requires no hiking to bird
habitats, hunters come to shoot ducks. Instead of enjoying the challenge of hunting in the woods, these hunters
have found a natural shooting gallery. Since 2018, there has been an increase in the number and frequency of
hunters parking at the beach and shooting in the lagoon area. The last weekend of 2021-2022 "water foul"
season had a group of five hunters, with dog and two trucks parked at the lagoon, shooting from one to six PM in
the lagoon area.
The community is concerned about the safety to our animals, children and property. The repeated noise over
that long period of time was, at times, as intrusive as a Forth of July celebration. The residents hoped that the
"no trespassing" signs would be sufficient discouragement but the hunters know that they can claim "permission
by owner to hunt" and the Sheriff cannot remove them. The deputy sheriff who responded to my last call stated
that the owner of the property has to report trespassing in order for him to cite the hunter. The owner of the
lagoon area, Discovery Bay Land Company, is not based on the property to see the hunting activity. The
residents of Gardiner are.
Conclusion:
The residents of Gardiner trust the Jefferson County Board of Commissioners will agree with our petition and
designate our Gardiner Beach a no shoot area in order to
• insure the safety of the residents and visiting public,
• provide protection of property, and
• keep the preservation of our wild life habitat.

In accordance with RCW 9.41.300, this petition requests the creation of a no shoot area because"there is a
reasonable likelihood that humans, domestic animals, or property may be jeopardized" if firearms are discharged
within this area.
Petition Proposal:
To designate the beach and parking area in Gardiner as a NO SHOOT AREA.
Description:
"Gardiner Beach" is an area in Gardiner that is approximately 1800 feet of shoreline running east to west by 500
feet of wetlands going south. Besides having a public boat launch, managed by the Port of Port Townsend and a
publicly used beach, there are wetlands and a lagoon that are naturally fed by run-off streams and ocean tides.
Except for the boat ramp and parking area (Dept. of Fisheries#002341019), the lands are privately owned by
Andre Mercier#002341008 and Discovery Bay Land Co. #002341015. (Map is enclosed)
Gardiner Beach Road, running east to west along the shoreline, is protected from the waters of Discovery Bay
by a barrier of boulders, drift wood and vegetation. Because the Gardiner Beach area has a mild climate, it has
become the breeding ground and year round habitat for many bird species including Canadian geese, mallard
ducks, Great Blue Herons and bald eagles.

Beginning at the Southeast corner of the Southwest '/4 of said Section 27;
thence South along the center section line of said Section 34, 153.88;
thence South 77° 59' 50" East 102.22;
thence continuing South 77° 59' 50" East 60 feet to the True Point of Beginning;

Establishing a "No Shooting Area"
for
Gardiner Beach
I HEREBY CERTIFY that this office has checked the attached petition establishing a "No Shooting
Area"for the designated area stated above as defined on the petition.
Said Petition was received by the Jefferson County Auditor's Office on February 23, 2022. Four
(4) pages were submitted which contained a total of twenty (20) signatures. There were at least
20 valid signatures as required by Jefferson County Ordinance No. 02-0416-07. Pursuant to
the Jefferson County Ordinance No. 02-0416-07 Section 5 (a), a petition filed by residents
containing the signatures of at least 20 elector-residents of each voting precinct in the area
under consideration.
Said Petition meets the requirement of having not less than 20 valid signatures from eligible
electors within the area defined as Gardiner Beach on the petition submitted and is now
Certified as being Sufficient.
