HomeMy WebLinkAbout071 98 STATE OF WASHINGTON COUNTY OF JEFFERSON IN THE MATTER OF A RESOLUTION} PRIORITIZING WORK TASKS TO } BE IMPLEMENTED IMMEDIATELY} Resolution No. AFTER ADOPTION OF THE JEFFERSON} COUNTY COMPREHENSIVE PLAN } 71-98 The Jefferson Board of County Commissioners hereby resolves: Whereas, the Jefferson County Board of Commissioners adopted a Comprehensive Plan under 36.70A RCW, and Whereas, County regulations and policy need to be reviewed in an expedited manner for consistency and compliance with the adopted Comprehensive Plan, and Whereas, the Board of County Commissioners resolve to finalizing development regulations and the new Procedural Refonn Ordinance (Land Use Applications Procedure Ordinance) and the Code Interpretation Ordinance (Procedures and criteria to Clarify Land Use Regulations) within a sixty (60) day period immediately following adoption of the Comprehensive Plan to implement the Plan on an interim basis while final development regulations are being developed in accordance with 36.70A RCW, and Whereas, the Board of County Commissioners resolve to revise the Shoreline Management Master Program which should occur within 365 days from Plan adoption to incorporate recent State amendments to the State Shoreline Management Act and to bring the County's Shoreline Management Master Program into consistency with the adopted Comprehensive Plan, and Whereas, the Board of County Commissioners resolve to ensuring land use activities pennitted under the Shoreline Master Program retain legal status to continue to operate after completion of revisions to the shoreline designations contained in the County's Master Program, and Whereas, the Board of County Commissioners resolve to investigating the possibility of developing regulations and perfonnance criteria for marine trades industries and other possible appropriate land uses in the Port Hadlock and Quilcene communities, for inclusion in the County's revised Shoreline Master Program, and Whereas, the Board of County Commissioner resolve to adopt a Noise Overlay Ordinance within 120 days of Plan adoption to protect against future noise conflicts in and around the vicinity of the Jefferson County International Airport, and VOL 2A 'H~ If: (".,'~ 2092 Whereas, the Board of County Commissioners resolve to review the County's Interim Resource Lands Ordinances and Critical Areas Ordinance to ensure they are consistent with the adopted Comprehensive Plan, and Whereas, the Board of County Commissioners resolve to review the County's SEP A Ordinance within 120 days of Plan adoption and make the necessary changes to ensure this ordinance complies with recent amendments to the State Environmental Protection Act and to ensure this ordinance is consistent with the adopted Comprehensive Plan, and Whereas, the Board of County Commissioners resolve to coordinate planning efforts with various governmental agencies and Special Districts, including, but not limited to the City of Port Townsend, Port of Port Townsend and Public Utility District No.1 of Jefferson County (PUD), and Whereas, the Board of County Commissioners recognizes the authority granted the Port of Port Townsend and the Public Utilities Districts prescribed under State statute, and Whereas, the Board of County Commissioners resolve to cooperate with the Jefferson County PUD #1 in developing a Inter-local Agreement establishing mutually acceptable policies coordinating County and PUD planning efforts, and Whereas, the Board of County Commissioners resolve to encourage the Port of Port Townsend to update the Sub Area Plan for the Jefferson County International Airport and the County agrees to work with the Port towards this goal in a cooperative manner, and Whereas, the Board of County Commissioners resolves that the submission of the Airport Sub Area Plan is not subject to the timing or conclusions of the Tri Area/Glen Cove Special Study, and Whereas, the Board of County Commissioners resolves that according to the provisions contained in the County-wide Planning Policy, the Joint Growth Management Steering Committee may review and comment on all plans submitted for County approval, but the final authority for adoption is at the discretion of the BOCC, and Whereas, the Board of County Commissioners resolves to review the County Wide Planning Policy (CWPP) to ensure consistency with the adopted Comprehensive Plan. This review and revision of the CWPP shall also include new language to ensure the County's ability to implement provisions contained in recent amendments to the GMA (36.70A RCW), and Whereas, the Board of County Commissioners resolves to consider expanding the voting membership of the Joint Growth Management Steering Committee as established in the adopted CWPP to possibly include membership from Special Districts, the Port Ludlow Master Planned Resort and possibly other entities, and VOL 24 ~AŒ 2093 Whereas, the Board of County Commissioners resolve to review and amend the Comprehensive Plan as necessary when the Tri-Area/Glen Cove Special Study is completed, and WHEREAS, the Board of County Commissioners resolve to continue providing information to the general public about the Comprehensive Plan through the development of a public education and awareness program, and Whereas, the Board of County Commissioners resolves that these items cited above be addressed in a timely manner and in an cooperative environment immediately following adoption of the Comprehensive Plan, NOW THEREFORE, BE IT RESOLVED, that the following tasks be prioritized for immediate attention: 1. County Planning staff will schedule a series of workshops and public hearings to facilitate the review and adoption of Development Regulations, the new Land Use Applications Ordinance (Regulatory Reform) and the new Procedures and Criteria to Clarify Land Use Regulations during the first sixty- (60) days immediately after adoption of the Comprehensive Plan. 2. County Planning staff, in cooperation with the Jefferson County Planning Commission shall identify funding for, and initiate review of the County's Shoreline Management Master Program. This review shall include identifying and recommending changes necessary to bring the County's Shoreline Master Program into compliance with State requirements and the adopted Comprehensive Plan. Revisions to the Master Program shall also include consideration of retaining the legal rights of land use activities to continue to operate as previously permitted under the Shoreline Master Program. In addition, this review shall include developing performance standards and performance criteria for marine trades industries and other possible appropriate land use activities in the Port Hadlock and Quilcene communities. These revisions shall be considered in a cooperative manner with representatives from the Port of Port Townsend and members of the general public. Any and all studies necessary to support marine trade activities on Port owned property in these communities shall be the sole responsibility of the Port of Port Townsend. Review and amendments to the Shoreline Master Program shall be initiated immediately after Plan adoption and completion should occur within 365 days after Plan adoption. 3. County Planning staff, in cooperation with the Jefferson County Planning Commission shall initiate review of the County's Interim Resource Lands Ordinances and the County's Interim Critical Areas Ordinance for consistency with the County's Comprehensive Plan. This review shall be completed within the statutory timeframe. VOL 24 rAf,~ 2094 4. 5, 6. 7. 8. 9. County Planning staff, in cooperation with the Jefferson County Planning Commission shall initiate review of the County's SEPA Ordinance and make the necessary changes to ensure compliance with changes to State regulations. Review of this ordinance shall commence upon Plan adoption and should be completed within 120 days after Plan adoption. County Planning staff, in cooperation with the Jefferson County Planning Commission shall initiate review ofthe Noise Overlay Ordinance prepared by the Port of Port Townsend and make a recommendation to the BOCC for adoption of this ordinance, This task should be initiated upon adoption of the Plan and should be completed within 120 days after Plan adoption. The County will cooperate with the Port of Port Townsend to revise the existing sub area plan for the Jefferson County International Airport which may include the evaluation of, and recommendations for, accommodating non-aviation related land uses and activities that are compatible with the airport facility and the surrounding rural environment. County Planning staff, under the direction of the Board of County Commissioners shall initiate review of the County Wide Planning Policy (CWPP) within 60 days after Plan adoption. This review shall include recommended amendments to facilitate the County's desire to utilize provisions contained in recent amendments to the GMA and to consider the addition of officials from Special Districts and the Port Ludlow Master Planned Resort to the voting body of the Joint Growth Management Steering Committee. The County will initiate and resolve any mapping errors brought to its attention that occurred due to technical problems or erroneous interpretation and application of the criteria contained in the Plan. The County will investigate and work towards resolving conflicts between resource extraction land use activities and the immediate surrounding areas due to pre-existing underlying density designations. 10. The County will initiate discussions with PUD No.1 to develop an inter-local agreement between the County and PUD that establishes mutually acceptable policies to coordinate County and PUD planning efforts. 11. The County will continue cooperating with the City of Port Townsend and other appropriate entities to facilitate the completion ofthe Tri-Area/Glen Cove Special Study. 12. The County will develop a program by which information about the Comprehensive Plan is communicated to the general public to provide a better understanding of the meaning and intent of the Comprehensive Plan.
