WHEREAS, the Jefferson County Board of Commissioners has reviewed a road vacation
petition submitted by Gary & Colleen Jensen; and
WHEREAS, the Jefferson County Hearing Examiner held a public hearing on the road
vacation petition on September 5, 1995; and
WHEREAS, the Jefferson County Hearing Examiner considered testimony of the public,
comments from applicable departments, agencies and offices, and recommendation from the
Jefferson County Public Works Department and Jefferson County Planning Department at the
public hearing; and
WHEREAS, the Jefferson County Hearing Examiner determined at the public hearing that
the public will benefit from the vacation of this portion of road and such vacation complies with
the Jefferson County Comprehensive Plan and other applicable plans, policies or ordinances; and
WHEREAS, the Jefferson County Board of Commissioners considered said Hearing
Examiner's report of the public hearing and his recommendation for the vacation request and
hereby adopts the Findings of the Jefferson County Hearing Examiner dated September 12, 1995;
and
WHEREAS, the petitioners have conveyed to Jefferson County a Statutory Warranty Deed,
recorded under AFN 414998, Vol. 622, Page 977, for right of way, for that portion of land
described as the North 26 feet of Lot 16 and Lots 18 through 29, Block 21, Plat of Chalmer's
Second Addition, per Plat recorded in Volume 3 Plats, Page 9, records of Jefferson County, lying
southerly of, parallel to, and contiguous with the southerly right of way margin of the platted
alley and lying easterly of the easterly right of way margin of Rhody Drive, SR 19, and westerly
of the westerly right of way margin of Seventh Avenue.
Together with that portion of Lot 16 and Lot 17, Block 21, Chalmer's Second Addition, lying
northwesterly of a 35 foot radius curve concave to the southeast and tangential to the easterly
margin of Rhody Drive, SR 19, and with a line parallel to and lying 26 feet south of the southern
margin of said platted alley per Plat of Chalmer's Second Addition, Plat recorded I Volume 3 of
Plats, Page 9, records of Jefferson County.
AND together with that portion of Lot 28 and Lot 29, Block 21, Chalmer's Second Addition,
lying northeasterly of a 35 foot radius curve concave to the southwest and tangential to the
westerly margin of Seventh Avenue, and with a line parallel to and lying 26 feet south of the
southern margin of said platted alley per Plat of Chalmer's Second Addition, Plat recorded in
Vlume 3 Plats, Page 9, records of Jefferson County.

All situate in Block 21, the Plat of Chalmers Second Addition Irondale, recorded in Volume 3 of
Plats, Page 9, Records of Jefferson County. A portion of E1/2 of the SE 1/4 of Section 3,
Township 29 North, Range 1 West, Willamette Meridian, Jefferson County, State of
Washington.
The land contained herein is approximately 0.26 acres and affects parcel numbers: 942902105
& 942902106.
NOW, THEREFORE BE IT RESOLVED that the following be vacated and abandoned
pursuant to RCW 36.87.140 and Jefferson County Road Vacation Ordinance No. 01-0102-96:
That portion of Rhododendron Avenue being 60 feet wide and approximately 540 feet long lying
east of the easterly margin of SR19 (Rhody Drive) and west of the westerly margin of platted 7th
Avenue in Chalmers Second Addition to Irondale, as recorded at Page 9, Volume 3 of Plats,
records of Jefferson County, Washington.
