HomeMy WebLinkAbout054 97 i,Þ - Cf.-;YltIJ1Mnj . . <: If-dfl-r7 . fJçU I1¡"1J (!ð/ý/MlóÓlð'Yl) JEFFERSON COUNTY State of Washington A Resolution Repealing Resolution No. 33-73 and Replacing with a Resolution Establishing a New "Reconstituted" Planning Commission Pursuant to Chapter 36.70.040 RCW; and Defining the Powers and Duties of the Planning Commission; and Prescribing the Number of Members; and Setting Forth Their Terms of Office } } } } } } } } } RESOLUTION NO. 54-97 WHEREAS, it is the desire of the Board of Commissioners to reconstitute the currently established County Planning Commission and County Shoreline Commission as an integrated Planning Commission; and WHEREAS County Resolution No. 33-73 established a County Planning Department and Planning Commission, as authorized by the Planning Enabling Act, codified as RCW 36.70 et seq.; and WHEREAS the Shoreline Commission was established by adoption of the County's Shoreline Master Program, adopted on March 7, 1989 and pursuant to the authority of the Shoreline Management Act, codified at RCW 90.58 et seq.; and WHEREAS the Regulatory Reform Act of 1995, codified as RCW 36.70B et seq requires that each local government, planning under RCW 36.70 et seq. shall establish a permit review process that provides for integrated and consolidated review; and WHEREAS the Board of County Commissioners abolished the Planning Commission established pursuant to Resolution No. 33-73 and the Shoreline Commission by oral Motion, made on January 13, 1997; and WHEREAS it is the desire of the Board to consolidate the Planning Commission, and the Shoreline Management Advisory Commission functions relative to Shoreline Master Program amendment proposals and policy development; NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners, Jefferson County, Washington, as follows: SECTION I. PLANNING COMMISSION RECONSTITUTED. The Board of County Commissioners, pursuant to the provisions of RCW 36.70.040 and pursuant to RCW 36.70B 120 (I) does hereby abolish the existing planning commission, consisting of nine (9) members and hereby establishes a new reconstituted Planning Commission which shall assist the planning department in carrying out its duties, including assistance in the preparation and execution of a county zoning ordinance and Shoreline Management Master Program, periodic updating of the Comprehensive Plan and Shoreline Management Master Program, and make recommendations to the department for the adoption of official controls and/or amendments thereto. SECTION 2. PLANNING COMMISSION CONDUCTS HEARINGS. The Planning Commission shall conduct such hearings as are required by RCW 36.70.010 et seq to and including RCW 36.70.960 and shall make findings of fact and conclusions therefrom which shall be transmitted to the Planning Department which shall transmit the same to the Board of Commissioners with such comments and recommendations as it deems necessary. VOL 23 rM;;284 I SECTION 3. POWERS AND DUTIES. The powers and duties of the Planning Commission shall be such as are now described by RCW 36.70.010 et seq and other applicable laws of the State of Washington. When directed to do so by the Board of Jefferson County Commissioners, the County Planning Commission shall also perform such other duties as are not inconsistent with state law. Upon request the commission shall assist the Jefferson County Planning Department and Jefferson County Board of Commissioners in carrying out the county's planning program and those duties prescribed by the Washington State Planning Enabling Act and the Growth Management Act. The commission shall assist and advise in the development of and any revisions to the Jefferson County Comprehensive Plan and Shoreline Management Master Program and official controls and/or amendments thereto, and carrying out those duties prescribed therein. The commission shall act as policy advisors in matters concerning general land use and shoreline use within the county. The commission shall recommend planning and shoreline policies to make certain they are consistent with the goals and policies of the community as expressed in the Comprehensive Plan and amendments thereto and the Shoreline Management Master Program and amendments thereto. The commission from time to time may also make inquiries, or develop reports or recommendations. The commission shall report in all matters referred to it within forty (40) days or within such time as specified by the board. The report of the commission shall be advisory only. SECTION 4. ADMINISTRATIVE RESPONSIBILITY (RELATING TO THE PLANNING COMMISSION). The position designated the duties of director of planning (RCW 36.70.160) shall be appointed by the Board of County Commissioners. The director shall be responsible for the proper operation of the planning department; shall be directly responsible to the Board of County Commissioners; shall have the responsibility of supervising the personnel of the planning staff; and shall be responsible for providing technical assistance to the planning commission. SECTION 5. FINANCING - PLANNING COMMISSION. The County Planning Commission shall incur no financial obligations nor authorize any financial expenditures except for such purposes as are expressly authorized in advance by the Board of County Commissioners in such manner as the law provides. Appropriations for the operation of the planning commission shall be identified, and the office accounting or other office records of finances shall be kept by the planning department. SECTION 6. RULES. The Planning Commission shall adopt its own rules and regulations governing the conducting of its internal affairs provided that such rules and regulations shall not be in conflict with State Law or County Resolutions. SECTION 7. APPOINTMENTS. Members of the Planning Commission shall be appointed by the Board of County Commissioners, and each commissioner district shall be equally represented on the planning commission. In the event a Planning Commission member changes residence during their term which moves them into a different commissioner district, they will remain in office until their term expires. After the term expires, the vacant position in the appropriate district will then be filled. SECTION 8. STAGGERED TERMS. To assure staggered terms of office for members of said planning commission as set forth in RCW 36.70.070, .080, .090, and .100, of the initial nine persons appointed members of the planning commission, two (2) shall be appointed for a term of one (1) year; two (2) shall be appointed for a term of two (2) years; two (2) shall be appointed for a term of three (3) years; and three (3) shall be appointed for a term of four (4) years. Thereafter each member appointed to the planning commission shall be (except when appointed to fill a vacancy) for a term of four (4) years. '2 VOL 23 r~~'; 265 The initial appointments to the planning commission shall be made effective the 18th day of March, 1997. Thereafter each four-year term shall commence on the 18th day of March of the year when the term created herein shall expire and the four-year anniversary thereof. SECTION 9. VACANCIES. Vacancies resulting from the expiration of terms of office shall be filled by appointments for a term of four (4) years. Vacancies occurring for any reason other than the expiration of a term of office shall be by appointment for the unexpired term of the office being filled. SECTION 10. ORGANIZATION. At its second meeting on May 7, 1997, the planning commission shall organize by electing a chairman and vice-chairman to serve until May, 1998. Thereafter, at the regular meeting in May of each year, the planning commission shall organize by electing a chairman and a vice-chairman to serve for a period of one (I) year beginning as of May of the same year. The planning commission may appoint standing or special committees to each of which it may assign specific responsibilities and authority provided only that such committee shall make no recommendations except to the planning commission. SECTION II. QUORUM - MEETINGS. Five members of the planning commission shall constitute a quorum. All actions of the planning commission shall be determined by a majority vote at a meeting of which a quorum is present. ~ . ~ - l { APPROVED AND ADOPTED this L~y of ~ 1997.
