IN THE MATTER OF A POLICY
TO ENSURE EQUAL OPPORTUNITY
IN HOUSING FOR ALL PERSONS
RESOLUTION NO.
59-97
WHEREAS Jefferson County entered into a conciliation agreement as a
means of resolving a housing discrimination claim filed with the Department of
Housing and Urban Development ("HOD") on November 4, 1996 under case
number 10-97-0037-8; and
WHEREAS the aforesaid agreement required the County to undertake
certain actions, including an acknowledgment of the county's commitment to
compliance with the Fair Housing Act; and
WHEREAS Jefferson County has already taken legislative action through
the adoption of several resolutions acknowledging the County's continuing
commitment to all anti-discrimination laws, including Resolution No. 9-94 (Fair
Housing Act) and Resolution No. 19-92 (American With Disabilities Act); and
further,
WHEREAS the Director of Community Development, pursuant to the
Jefferson County Code, has review and approval authority for certain
development permits;
NOW, THEREFORE, BE IT RESOLVED, that Jefferson County
acknowledges its continuing commitment to abide by the provisions of the Fair
Housing Act which requires that reasonable accommodation be made in the
application of rules, policies, practices, or the delivery of services, when such
accommodation may be necessary to afford disabled persons equal opportunity to
use and enjoý a dwelling.
BE IT FINALL Y RESOLVED, that the Jefferson County Director of
Community Development, pursuant to Jefferson County Code sections JCC
17.10.040 and JCC 18.95.010, has the authority under the county's land use laws
to approve requests for such accommodations made by disabled persons or by
agents of disabled persons acting on their behalf when the Director determines, in
consultation with the ADA Coordinator and other appropriate agencies, that such

accommodations are reasonably necessary to afford disabled persons equal
opportunity to use or enjoy a dwelling consistent with Federal law.
