JEFFERSON COUNTY State of Washington A Resolution Assigning the Jefferson } County Hearing Examiner the Duties to } Review, Hear and Make Recommendations} on Shoreline Permits } RESOLUTION NO. 71-<...97 WHEREAS, the Washington State Shoreline Management Act of 1971 and the Jefferson County Shoreline Management Master Program requires that counties and cities incur certain duties, obligations, and responsibilities with regard to implementation and review of all Shoreline uses and developments, including permits; and WHEREAS the Shoreline Commission was established by adoption of the County's Shoreline Master Program, adopted on March 7, 1989 and pursuant to the authority of the Shoreline Management Act, codified at RCW 90.58 et seq.; and WHEREAS, the Board dissolved the Jefferson County Planning Commission and Shoreline Management Advisory Commission (the "Shoreline Commission") by way of oral motion on January 13, 1997; and WHEREAS, the Board reconstituted both the Planning Commission and Shoreline Commission in the form of one integrated Planning Commission by way of Resolution No. 54-97, adopted on April 28, 1997; and WHEREAS, prior to the dissolution of the Planning and Shoreline Commissions and reconstitution of the integrated Planning Commission, Section 6.10 of the Jefferson-Port Townsend Shoreline Management Master Program (the "SMP") vested various quasi-judicial responsibilities and duties in the Shoreline Commission; and WHEREAS the Regulatory Reform Act of 1995, codified as RCW 36.70B.120 (3) et seq. allows each local government, planning under RCW 36.70 et seq. to establish a permit review process that provides for integrated and consolidated review, even if by separate bodies; that the local legislative body has authorized a hearing examiner to hear and decide all quasi-judicial matters including but not limited to shoreline permits; and that amendments to the Regulatory Reform Act amending RCW 90.58.140 mandate that the local government establish a program for the administration and enforcement of the Shoreline Management permit system; and WHEREAS the Planning Enabling Act, RCW 36.70.970 (a), permits the Board of County Commissioners to vest in a hearing examiner the power to hear and decide shoreline permits; and WHEREAS, it is the desire of the Board of Commissioners to have the Jefferson County Hearing Examiner conduct the pre-decision public hearing on Shoreline Substantial Development Permits (SDPs); and I VOL 21 ~r. 413 """" ......... --- WHEREAS, this resolution is exempt from review under the State Environmental Policy Act [SEP A] as provided in, and pursuant to, WAC 197-11-800 (20) Procedural Actions.
