ORDER GRANTING
REQUEST FOR CONTINUANCE
The above-captioned consolidated hearing process was set to reconvene tomorrow,
May 12, 2022. Yesterday afternoon, Counsel for the Department submitted a written request
to continue and reschedule the hearing, based on new information and the need for additional
time to properly address the issue. Counsel for the other parties of record received the
Department’s request for a continuance and confirmed their agreement that the hearing
should not go forward tomorrow but should be continued.1
As provided in the Jefferson County Hearing Examiner Rules of Procedure, the
Examiner has the sole authority over the scheduling of hearings within their jurisdiction.
(HEx Rule 2.1(a)).
Consistent with HEx Rule 2.2, the Department’s request for a continuance includes
information sufficient to establish that there is good cause to continue this matter, and the
other parties of record support the request, so the request should be granted.
1 Copies of the Department’s written request for a continuance, and the emails from counsel for the applicant
and the appellants, supporting the request for a continuance, all transmitted to the Examiner’s Clerk in accord
with the HEx Rules of Procedure, shall be maintained as part of the record for this matter.

Accordingly, the hearing for the Pomona Woods Conditional Use Permit and SEPA
appeal is postponed and will not reopen tomorrow. The hearing is hereby continued to a
future date and time to be determined. Online notices and updates providing any rescheduled
hearing date(s) will be posted on the Department’s website when the matter is ready to move
forward.
