Copyright 2019. 1” = 100’N APPENDIX D Land Area Calculation Parcel Area: 921084010 - 4.4 Acres 921084011 - 3.9 Acres Total - 8.3 Acres According to Jefferson County records, parcel 921084010 is assessed at 3.28 acres and parcel 921084011 is assessed at 2.57 acres for a total of 5.85 acres. This area is exclusive of land delineat- ed as estuary as well as area delineated as Resort Road. According to relevant case law (Island County v. Dillingham Development Co., 99 Wash.2d 215), “Land” includes not only the soil or earth, but also things of a permanent nature af fixed thereto or found therein, whether by nature, as water, trees, grass, herbage, other natural or perennial products, growing crops or trees, mineral under the surface, or by the hand of man, as buildings, fixtures, fences, bridges, as well as works constructed for use of water, such as dikes, canals, etc. We conclude the definition of “land” within the ordinance in- cludes that part of the lots under water. Under this understanding, the area that should be included in the calculation of parcel size is inclu- sive of land within the property lines delineated as estuary as well as interior access roads.
