In the Matter of the Extension of the
Cash Out Provisions of Accrued Sick
Leave Benefits to Certain Elected Officials
RESOLUTION NO.

Whereas, the Personnel Policy provides for a cash out of accrued, but unused sick leave
at a ratio of one (1) hour cash out for each four (4) hours of accrued sick leave (25%) for employees
terminated by death, disability or retirement; and,
Whereas, a number ofJefferson County Elected Officials were employees of Jefferson
County before being elected to office in Jefferson County; and,
Whereas, once elected to office, elected officials do not accrue any employment benefits
other than those bestowed by State Statute; and,
Whereas, upon being elected to office, these elected officials had accrued sick leave
benefits; and,
Whereas, these individuals have no break in service for the citizens of Jefferson County;
and,
Whereas, some of these elected officials are now or will be eligible for retirement and the
sick leave cash out could effect their retirement benefits; and,
Whereas, Jefferson County has an established account for the purpose of paying for the
cash out of accrued benefits and subsequent employer obligations under the State retirement system.
Now Therefore Be It Resolved, that the sick leave cash out benefit available to non-
represented employees is hereby extended to elected officials in Jefferson County as follows:

The elected official has served the citizens of the County with no break in service from
employee to elected official. A break in service forfeits any accrued sick leave benefit.
The elected official had accrued sick leave benefits on the books prior to election to
office.
The elected official meets all other eligibility criteria established in the personnel policy.
