RESOLUTION NO. 19-96
A RESOLUTION of the Board of Commissioners of Jefferson County,
Washington, ordering certain road improvements and creating a road
improvement district; determining the sufficiency of the petition; providing
for the payment of the cost of such improvements by special assessments;
describing the method of assessment; creating a road improvement district
fund; and providing for the issuance and sale of road improvement district
bonds and interim financing warrants or notes.
WHEREAS, a petition (the "Petition") was filed with the Board of County Commissioners (the
"Board") of Jefferson County, Washington (the "County"), requesting the formation of a road
improvement district for the purpose of extending and/or improving the following roads: Bywater Way,
Hoodsview Court, Park View Lane, Olympic Ridge Drive, Hidden Springs Drive, Ship View Court, and a
portion of Bywater Way North and of making other related improvements; and
WHEREAS, the Director of the Department of Public Works determined that the Petition was
signed by the owners, according to the records of the County Auditor, of a majority of the lineal frontage
upon the improvements to be made and of the area within the limits of the road improvement district to be
created therefore, and that the improvements appear to be feasible, and that the benefits appear to exceed
the cost of the improvements, and
WHEREAS, on December 4, 1995, the Board adopted Resolution No. 116-95, declaring its
intention to order certain road improvements within the County and to create Road Improvement District
No. 3 ("RID No. 3"); and
WHEREAS, a heating was held on January 23, 1996, after notice as provided by law, and after
discussion of the proposed improvements and due consideration thereof and of all objections thereto, the
Board has determined to order the road improvements described below and to create a RID No. 3; and
WHEREAS, estimates of the costs and expenses of the proposed improvements, a description of
the boundaries of RID No. 3, a statement of what portion of the costs and expenses of the improvements
would be borne by the properties within RID No. 3, and a diagram showing the lots, tracts and parcels to
be benefited and other information pertaining to RID No. 3, have been filed with the Clerk of the Board and
certified to the Board;
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF JEFFERSON COUNTY, WASHINGTON, as follows:
Section 1. Findings. The Board finds that the Petition, including all additions thereto or
withdrawals therefrom made prior to 5:00 PM on May 9, 1995, is sufficient and that the property within
RID No. 3 is sufficiently developed to warrant the formation of RID No. 3.
Section 2. Improvements. The County shall make the following improvements to the above
referenced County roads, regarding, ballasting, and surfacing to bring the said roadways to County
standards. The foregoing improvements are hereafter referred to as the "Improvements." The territorial

extent of the Improvements are as shown on Exhibit A, attached hereto and incorporated herein by this
reference. The Board hereby finds that the plan for constructing the Improvements is feasible.
The County shall acquire by gift, purchase, franchise, lease or condemnation all property, both real
and personal, or any interest therein and all rights-of-way, franchises, permits and easements which may be
found necessary to acquire, construct, and install the Improvements. The Improvements shall be subject to
such changes as to details of said Improvements not affecting the service to be provided by the
Improvements, as shall be authorized by the Board either prior to or during the actual course of
construction.
Section 3. Estimated Cost. The estimated cost and expense of such Improvements (including those
expenses described in RCW 36.88.300) are declared to be approximately five hundred thousand dollars
($500,000). It is the intention of the Board that approximately ten percent (10%), but not more than One
hundred thousand dollars ($100,000), whichever is less of the costs and expense of the Improvements be
paid by the County. The balance of the cost of the Improvements will be borne by and assessed against the
property included in the RID herein established. The Board shall assess separately those properties
specially benefited by each Improvement.
Section 4. Establishment of RID No. 3. There is hereby established a road improvement district
of the County to be known as Jefferson County Road Improvement District No. 3 ("RID No. 3"). The
boundaries of RID No. 3 shall be as described on Exhibit A, attached hereto and incorporated herein by
this reference.
It is hereby found that the above-described boundaries embrace as nearly as practicable all the
property specially benefited by the Improvements and that the benefits to be derived from the Improvements
by the property within RID No. 3, together with the costs of the Improvements to be paid by the County,
exceed the costs and expenses of the formation of RID No. 3 and the construction of the Improvements.
[Section 5. Method of Assessment. The method of assessment to be used for RID No. 3 is as
follows:]
Costs shall be assessed by equal shares per lot. There are a total of seventy-two (72) lots,
therefore, based on the five hundred thousand dollars ($500,000) preliminary estimate, the cost per lot will
be approximately six thousand nine hundred and forty-four dollars ($6,944).
Section 6. Assessments. Upon completion of the Improvements, an assessment roll shall be
prepared and, at~er notice and hearing in the manner provided by law, an assessment roll shall be
confirmed. Assessments not paid within the 30-day prepayment period provided by law shall be payable in
installments and the County shall issue road improvement district bonds payable from such unpaid
installments. The number of years said installments shall run, the dates of payment of the same and the rate
of interest that the unpaid installments shall bear shall be as hereafter fixed by resolution.
Section 7. RID No. 3 Fund. There is hereby created a fund of the County to be known as the
"Road Improvement District No. 3 Fund" (RID No. 3") for the purpose of paying the cost of the
Improvements provided for in this resolution and into which there shall be paid all of the assessments
collected in RID No. 3, as and when directed by the resolution confirming the assessment roll. All moneys
received from the sale of bonds, notes and warrants drawn on the RID No. 3 Fund shall be deposited into
said Fund, and applied solely in payment of the costs and expenses of the Improvements.
Section 8. Interim Financing. Pending the issuance of road improvement district bonds, the
County may, for the purpose of meeting any and all costs and expenses of constructing the Improvements
for which funds are not otherwise available, as the same are installed prior to the sale of the bonds, issue
interim financing warrants against the RID No. 3 Fund, or issue road improvement district bond
anticipation notes pursuant to RCW Ch. 39.50, bearing interest at such rate or rates and with such terms as
may hereinafter be established by the Board by resolution. Such interim warrants or notes, together with
the interest due thereon to the date of delivery of the bonds, shall be redeemed and retired from the proceeds
of the sale of road improvement district bonds or prepayments of assessments. Such warrants or notes shall
be issued in an aggregate principal amount not in excess of the cost and expense of the Improvements.
