Hi Donna,
I believe you are currently reviewing the BDN Smersh Parcel shellfish aquaculture project (Corps #201301268) for a
shoreline permit in Jefferson County.
I was hoping to check in with you on a few items:
• Has a SEPA threshold determination been made yet? (and if not, can you notify me when that happens?) A SEPA
threshold determination has not yet been made for this application, but I can let you know when the county
issues the threshold determination.
Does the County feel that the grower has adequately addressed or remedied attempts in the past to divert
freshwater inputs onto the property? I have on file some complaints about a culvert being added to the stream
in the early 90's and it seems that the county responded with a stop work until a permit or exemption is issued.
(see attached) DCD is keeping violations separate from the current application. Given the timeframe of this
complaint, I would have to work with our code compliance coordinator on this. I will get back to you as soon as
possible but it may not be until sometime in June.
I am a little confused as to whether this project has previously been permitted. The obvious answer seems to be
no, but it also seems that maybe other parcels within this project have been previously permitted but the
721031007 parcel has not — yet we are using the same name so that's why it may be confusing? I'm hoping the
Corps and/or the County can provide some clarity on this. This project has not been permitted; however the
applicant (BDN) does have an existing aquaculture farm elsewhere in Squamish Harbor, which was permitted by
the Corps at a time when Jefferson County did not have jurisdiction over aquaculture in our SMP (i.e., prior to
February 2014). Note that, given the relatively recent federal court decision for aquaculture, BDN is in the
process of getting a new federal permit for the existing aquaculture farm as well as federal and county permits
for the new one.
Does the County have any other major concerns with this project at this time? The county has received many
comments from those who reside in the vicinity of the proposed project. At this time, the county has not
determined if the additional information we requested has been submitted by the applicant.

very limited hours until I return to the office. Please let me know if you would like me to call you when I return.
