Proposed No Shooting Areas in Cape George and Gardiner Beach
Jefferson County Courthouse —Commissioners' Chambers

CALL TO ORDER: Chair Heidi Eisenhour, Commissioner Kate Dean and Commissioner Greg
Brotherton participated in the meeting remotely. Chair Eisenhour called the meeting to order at the
appointed time. She explained the purpose of the meeting is to hear from the local Tribes and the public
regarding the proposed No Shooting Areas (NSA)s in Cape George and Gardiner Beach.
TRIBAL COMMENTS: One member of the Point No Point Treaty Council provided comments.
PUBLIC COMMENTS: Fifteen individuals provided comments.
PRESENTATION: Chief Civil Deputy Prosecuting Attorney (DPA) Philip Hunsucker provided a
presentation on the Smaller Cape George proposed No Shooting Area(NSA), the Larger Cape George
NSA and the Gardiner Beach NSA. He noted that the Board of County Commissioners has the final
authority regarding No Shoot Areas per Jefferson County Code (JCC) 8.50.050(6), and that Washington
State law limits the scope of any NSA. The County is also required to request local Tribal input. Chief
DPA Hunsucker stated that the Commissioners can choose one of three options for moving forward:
They can hold a hearing, facilitate an amicable solution within the proposed area, or assign a review
committee.
After review and discussion of the No Shoot Areas, Commissioner Brotherton moved to hold a hearing
to consider the merits of the Smaller Cape George Area No Shooting Area proposal. Chair Eisenhour
seconded the motion. Commissioner Dean stated she would also like to hear from neighbors in the more
dense areas of that proposed NSA as well. She also noted that there may still be hunting going on at the
edge of the boundary, if approved. Chair Eisenhour called for a vote on the motion. The motion carried
by a unanimous vote.
Commissioner Brotherton noted that as they have not heard back yet from a private land owner in
Gardiner Beach, he is not ready for a hearing on the proposed NSA in that area. After discussion, Chair
Eisenhour moved to pursue a facilitated solution for the proposed Gardiner Beach NSA and that
Commissioner Brotherton will lead that facilitation effort. Commissioner Dean seconded the motion
which carried by a unanimous vote.
PUBLIC COMMENTS: Six individuals and one member of the Point No Point Treaty Council
provided additional comments.
