ORDINANCE NO. 05-0621-05
WHEREAS, the County has worked for many years diligently on an Urban Growth Area
for the Port HadlocklIrondale community; and
WHEREAS, the Western Washington Growth Management Hearings Board has
invalidated in its Final Decision and Order dated May 31, 2005 the development regulations and
Comprehensive Plan relating to permitting urban densities without a parallel capital facilities
plan; and
WHEREAS, in response to the finding of invalidity, the Board of County Commissioners
has reverted the interior of the UGA to the Rural Standards that were in place before adoption of
the UGA in August of 2004; and
WHEREAS, the sewer service area maps of the Urban Growth Element adopted in
August 2004 remain valid; and
WHEREAS, the County remains committed to Port HadlocklIrondale UGA; and
WHEREAS, the invalidated development regulations contained provisions necessary for
developing urban services; and
WHEREAS, the invalidated development regulations restricted uses incompatible with
urban environments; and
WHEREAS, allowing development inside the UGA that will not fund the sewer system
will preclude urban uses and intensities at those locations; and
WHEREAS, RCW 36.70A.390, a section ofthe Growth Management Act (Ch. 36.70A
RCW), authorizes a County to adopt a moratorium on development permits and approvals for
mini-storage facilities and thereafter to hold a public hearing on the moratorium within 60 days
of the commencement of the moratorium;

NOW THEREFORE BE IT ORDAINED by the Board of County Commissioners as
follows:
SECTION 1. Moratorium Established. A moratorium is imposed upon the filing with
the County any applications for pennits or approvals for mini-storage facilities in the Rural
Commercial designations for the Port Hadlock Rural Village Center.
SECTION 2. Additional or new applications for pennits or approvals of mini-storage
facilities in the LAMIRD known as Irondale Road and Ness' Comer are also prohibited by this
moratorium.
SECTION 3. A No Protest Sewer Agreement must be signed by or on behalf of the
applicant as a condition of development within the sewer service areas, i.e., issuance of any
necessary pennits by the County.
SECTION 4. Severability. If any provision of this ordinance or its application to any
person or circumstance is held invalid, the remainder of the ordinance, or the application of the
provision to other persons or circumstances is not affected.
SECTION 5. This ordinance shall take effect immediately after passage.
