WHEREAS, by Contract For Treasurer's Deed dated May 18, 1962, certain
real property was purchased from Jefferson County by Karmet G. Hilson and
Joe P. Germeau, and
WHEREAS, that Contract included a reservation for right of way easement
for all public highways which may be constructed by the authority of the Board
of County Commissioners of Jefferson County, and
WHEREAS, Wallace W. Higdon and Lulu B. Higdon, his wife, represent
that they are the present owners of the property conveyed by the above - referenced
Deed, and
I- - WHEREAS, the present owner of the said property anticipates constructing
certain improvements on that property but is unable to obtain financing because
of the easement referred to above, and
WHEREAS, the said property is situated adjacent to State Road No. 20,
which has an existing right of way of one hundred feet, and
WHEREAS, Jefferson County has no plans for construction of a highway
on the said property and there is no foreseeable need of that property for
highway purposes, and with no foreseeable need of the property for highway
purposes the easement has no value to Jefferson County;
NOW, THEREFORE, it is hereby resolved that Jefferson County shall
convey by Quit Claim Deed its easement for highway purposes over and across
the real property, described below, to Wallace W. Higdon and Lulu B. Higdon,
his wife, the successor in title to Karmet G. Hilson and Joe P. Germeau.
The said real property is described as follows:
Lots 2 to 4 inclusive and lots 9 to 12 inclusive, in Block
25 of Eisenbeis Bayview Addition to Port Townsend, as per plat
recorded in volume 2 of Plats, page 54, records of Jefferson County,
EXCEPT that portion of said lots 3,4,9, and 10 taken for State
Road No. 9, (now State Road No. 20), situate in the City of Port Town-
send, County of Jefferson, State of Washington.
