HomeMy WebLinkAbout007 94 In the matter of VOl.yì~~2~~ fNZiloE1 OF OfF!Gi.~l R::COROS REQUEST OF ~D úní\ CDOpeý STATE OF WASHINGTON 1994 JAB 12 PMlJ: 2~ COUNTY OF JEFFERSON f{¡.iRY E, G¡\BOURY J~Ç!.~~~~~:,OR RESOLUTION NO. )-94 ' 367707 x The Statutory Vacation of A Portion of Phillips Ave. And of Louisa Street In the Plat of Phillips Bay View Addition x x x x x WHEREAS, the Jefferson County Board of Commissioners has reviewed a road vacation petition submitted by Donald and JoAnn Cooper; and WHEREAS, real property was dedicated to Jefferson County for road purposes in an instrument dated June 10, 1890, and filed with the Jefferson County Auditor at Page 87, Volume 2 of Plats; and WHEREAS, Jefferson County has not opened the following described right of ways for public use for road purposes within five (5) years of obtaining an interest in the real property for road purposes: That portion of platted, unopened Phillips Avenue being 60 feet in width lying east of the easterly margin of platted Sophia Street and west of the westerly margin of platted Elizabeth Street in Phillips Bay View Addition, as recorded at page 87 of Volume 2 of Plats, records of Jefferson County, Washington; along with that portion of platted, unopened Louisa Street being 60 feet in width and lying south of the southerly margin of platted Thomas Street and north of the plat boundary in said plat. WHEREAS, RCW 36.87.090 provides that any road unopened for public use for five (5) years after the authority is granted for opening it shall be thereby vacated and the authority for building it barred by lapse of time; and WHEREAS, the above-described roads were vacated by operation of law and the County divested of its interest before the 1909 amendment, Laws of 1909, Chapter 90, Section 1, which exempted from vacation by operation of law certain lands dedicated for road purposes, became effective; and WHEREAS, the Jefferson County Board of Commissioners desires to remove this cloud on title to the real property; NOW, THEREFORE BE IT RESOLVED that the dedicated platted roads more particularly described above have been vacated by operation of law and Jefferson County asserts no claim of interest for public road purposes in them. VOL 20, lC')!"'- t.~; - .j JAJt12 Wt 44::" '85"(1 VOl. , ..J1>A..c v NGINEER'S REPORT OF EXAMINATION STATE OF WASHINGTON COUNTY OF JEFFERSON To the Board of Jefferson County Commissioners The County Engineer of Jefferson County, has examined the county right of way known as That portion of platted, unopened Phillips Avenue being 60 feet in width lying east of the easterly margin of platted Sophia Street and west of the westerly margin of platted Elizabeth Street in Phillips Bay View Addition, as recorded at page 87 of Volume 2 of Plats, records of Jefferson County, Washington; along with that portion of platted, unopened Louisa Street being 60 feet in width and lying south of the southerly margin of platted Thomas Street and north of the plat boundary in said plat, and petitioned by Don and JoAnn Cooper to be vacated and abandoned, and herewith submits the following report thereon: This street was platted on June 10, 1890, in the plat of Phillips Bay View Addition. There has never been a road constructed on this right of way, nor has it been opened for public use, since it was platted; it is therefore vacated by statute.
