RESOLUTION NO. 14-94
ORDER
BUDGET APPROPRIATIONS/EXTENSIONS
VARIOUS COUNTY DEPARTMENTS
WHEREAS, the Jefferson County Board of Commissioners did on the 10th day of
January, 1994, declare that an emergency existed to provide the listed amounts from the unencum-
bered balances of the identified funds and to set a hearing on said emergency for the 18th day of
January 1994, at the hour of 2:00 p.m.; and
WHEREAS; this being the time and place set for said hearing and no objection or
objection interposed; now, therefore,
IT IS HEREBY ORDERED, by the Board of County Commissioners, that due to there
being sufficient funds in the unencumbered fund balances of the Fund listed, that the County Auditor
be, and she is hereby authorized to extend the budget of the following funds by the amounts listed
below and per the attached request.

Gentlemen:
Please be advised that after a thorough examination of my current budget it app-ears that the amount
allocated in BARS Account No. 511. 70 of $ 700.00 of the CLERK HIRE
category is insufficient to pay necessary expenses of this department for this year. After a careful
examination of all the expenditures within the department budget with respect to present and future
needs, I find there are no funds available to transfer into the deficient account. Therefore, I request
an emergency appropriation in the amount of $ 700.00 for this current year for the following
reason(s) as outlined below:

The recent legislative change in withholding social security
tax from election workers earning over $100 in a calendar year

Gentlemen:
Please be advised that after a thorough examination of current budget for the District Court it
appears that the amount allocated in several of the BARS account numbers are insufficient to pay
necessary expenses of this Department for this year. After a careful examination of all the
expenditures within the department budget with respect to present and future needs, I find there are
no funds available to transfer into the deficient account. Therefore, I request an emergency
appropriation in the amount of $23,645.36 for this current year for the following reasons as outlined
below:

since I am requesting a "healthy" emergency appropriation, I felt
a short memo was in order before you tackled my requests. Please
keep in mind that District Court just experienced it's busiest year
ever (actually, by the time the stats are done, we may be even with
1989 in filings). I don't have the end of the year stats completed
yet, but we have experienced an approximate 40% over-all increase
in filings. The busier we are, the more it cost to keep our doors
open.
Please consider the while the extra filings created more spending
it also brought in far more revenue than was budgeted. And if the
filings turn out to be the same as 1989 which has been the busiest
year so far, the revenue almost doubled from 1989's figure. What
that means is that while we have been as busy as that year, we have
made better use of what resources we have and have collected more
money!

REASONS FOR APPROPRIATION
Glerk Hire:
"
When it became apparent that the filings were going to continue at
the rate at which they began during the first part of 1993, I
requested another emergency clerk position. . The position was
granted, but not to exceed $2000.0p. Obviously, those funds went
quickly. I returned to the Board with a request for a full time
clerk. This position was granted as a temporary 8 hour a day
position until year end. Now I need the funds to cover that
position.

REASONS FOR APPROPRIATION

OFFICE SUPPLIES
During 1993 budget negotiations, I advised the budget director that
the amount I had requested was a ~inimum figure of what I would
anticipate needing in 1993 due to the new DISCIS system and the
required new forms. The requested amount was reduced. Because of
the reduction, and because printing costs were more than
anticipated for new forms I I have well over-spent the allotted
funds for this category. Inflation should be considered as a
contributing factor, as well.

Court Appointed Attorney:
A court appointed attorney is apppinted when the public defender
has a conflict and cannot represent an indigent defendant. For a
more detailed explanation see budget transfer documents which
accompany the appropriation documents.

REASONS FOR APPROPRIATION

Judge Pro Tem:
More than anticipated cases came be~ore the bench this year wherein
Judge Majhan was either affidavited* or he recused himself due to
a conflict. As the years go by with one judge on the bench, more
and more cases will arise where a defendant does not feel he/she
can receive a fair and impartial judgement from the judge.
Usually, an affidavit is filed by a repeat offender who doesn't
want to go before the same judge again and again.
* A defendant may file an AFFIDAVIT OF PREJUDICE against any judge
for any reason which does not have to be revealed so long as he/she
does it according to court rule.
