IN THE MATIER OF REACfIVATING
THE JEFFERSON COUNTY HOUSING

RESOLUTION NO. 25-94
WHEREAS, Jefferson County established a housing authority pursuant to Chapter 35.82
WHEREAS, the authority subsequently accomplished its' mission and became inactive,
WHEREAS, the issue of affordable and emergency housing has become a community
issue of concern, and;
WHEREAS, an active Housing Authority can assist in the development, and
implementation of a housing strategy to address the housing and shelter needs of the community.
NOw, THEREFORE BE IT RESOL VED, that the Jefferson County Board of
Commissioners does hereby reactivate the Jefferson County Housing Authority.
BE IT FURTHER RESOLVED, not withstanding, and in addition to, the duties and
responsibilities as provided under Chapter 35.82 RCW, the Jefferson County Authority is being
reactivated to accomplish the following tasks:
1) Assist the Planning Departments of the City and County in developing a local
definition of "affordability."
Developing a strategy for addressing the affordability and emergency shelter
needs of the community.
Develop an assessment of land availability and a process for siting special
purpose housing (such as, homeless shelters, group homes, etc.)
Assist the Planning Departments of the City and County in developing the
housing elements of the Comprehensive Plan updates pursuant to the Growth
Management Act.
Assist the Building Departments of the City and County in reviewing the local
discretionary regulations and policies for impacts on housing costs and
recommend options to reduce impacts on housing costs.
Act as a focal point and coordinating entity to address affordability and special
housing issues.
Act in accordance with the Countywide Planning Policies adopted pursuant to
ReESHB 1025 of the Growth Management Act.

BE IT FURTHER RESOL VED, that the Clallam Jefferson Community Action Council
is hereby assigned the task of assisting the Housing Authority to become operational by acting as the
Authority staff for a period of one year from the date of this resolution. Following the one year
startup, the Authority may, at its' discretion, continue the services of the Community Action Council.
BE IT FINALLY RESOL VED, that this Resolution rescinds and replaces Resolution 25-
92 approved on April 6, 1992. . t

Housing Authorities - Checks and Balanoes
Who appoints the Commissioners of a Housing Authority?
The County commissioners appoint five persons to staggered five
year terms.
liThe Commissioners who are first appointed shall be designated to
serve for terms of one, two, three, four and five years..." (RCW
35.82.040)
Can the Commissioners of a Housing Authority be removed from
office?
The County Commissioners can elect not to reappoint a housing
authority commissioner. A commissioner can be removed by the
County Commissioners for inefficiency, neglect of duty or
misconduct in office. (RCW 35.82.060)
Can a Housing Authority condemn property?
A housing authority does have the power of Eminent Domain and can
exercise its powers like other municipal corporations. No real
property owned by the city, county, the state or any other
political subdivision may be acquired without its consent. (RCW
35.82.110)
other entities also have some powers of Eminent Domain, including
port authorities, school, water, and cemetery districts, and .even
some private corporations (electric companies).
Does a Housing Authority have to comply with local zoning laws
and building codes?
. Yes, they are..."subject to the planning, zoning, sanitary and
building laws, ordinances and regulations applicable to the
locality in which the housing project is situated." (RCW
35.82.120)
Can a Housing Authority obligate the County through issuing
bonds?
No, a housing authority may only issue bonds secured by the
incomes, revenues and assets of the housing to be developed, or
other assets of the authority.
"... the bonds and obligations of an authority... shall not be a
debt of...the county..." (RCW 35.82.130)
Bonds secured by assets of a housing authority are reviewed using
similar underwriting criteria as used for private financing. In
each case there must be some way to repay the debt. The bonds
are, however, tax exempt, resulting in lower interest rates.

Dear Mr. Tickell:
Enclosed you will find the annual review report resulting from my visit to your office on
March 1 and 2, 1994, to review the Housing Quality Standards (HQS) component of the
Section 8 Rental Assistance Program. The review consisted of an inspection of 11 units or
five percent of the units under a Section 8 lease (whichever was greater), and a discussion of
the results with your Section 8 staff. Please respond within 60 days of receipt of this report
concerning the status of each finding and comment.
Eleven units were inspected and five failed. Of those that failed, no unit had a pre-existing
condition, that is, a failing item. that should have been cited by the inspector and corrected at
the last inspection.
I was impressed with the overall condition of the majority of the units that I saw. It was
apparent that not only are your staff able to keep the landlords motivated to maintain the
units, but the tenants as well seem to take responsibility for their homes. I think that this
shows the hard work and dedication of your staff toward maintaining a quality Section 8
program.
