't-~-1lf STATE OF WASHINGTON County of Jefferson IN THE MATTER OF AN declaring an emergency to preserve the status quo, pursuant to Chapter 36.70.790 and Chapter 36.70A.390 Revised Code of Washington } } } } RESOLUTION NO......9.1=.24 WHEREAS, the Western Washington Growth Management Hearings Board has ordered (Final Order #94-2-0006) Jefferson County to: 1) 2) Eliminate unincorporated interim urban growth areas, Clarify language concerning new urban residential, commercial and industrial development, and Adopt appropriate rural densities; and 3) WHEREAS, compliance with provisions 1 and 2 above must be taken within thirty (30) days of the final order and provision 3 within sixty (60) days of the order; and WHEREAS, there is insufficient time to properly develop the amendatory language within the time frame allowed, and WHEREAS, the Jefferson County Board of Commissioners does hereby declare that an emergency exists; WHEREAS, the Board finds that this resolution preserves the status quo, pursuant to RCW 36.70.790 and RCW 36.70A.390, pending development and adoption of amendatory language, and this resolution may be adopted without notice, without holding a public hearing. The Board also finds that this resolution is exempt from State Environ- mental Policy Act (SEP A) review as provided in and pursuant to Washington Administra- tive Code 197-11-800; NOw, THEREFORE, BE IT RESOL VED, that the designation of interim urban growth areas outside the municipal boundaries of the City of Port Townsend con- tained within Ordinance #02-0110-94 as amended, are hereby declared nuII and void; however, the areas identified in Attachment C, Tri-Area and Attachment D, Port Ludlow shall continued to be studied and analyzed for the purpose of future consideration as urban growth areas, and 1) That a moratorium is declared and no application shall be accepted, nor formal pre-application consultation or review be conducted for projects subject to the following sections of Ordinance #04-0526-92, Subdivision Ordinance: Section 5 Short Subdivisions, Section 6 Long Subdivisions, Section 8 Mobile Home Park Divisions, Section 9 Recreational Vehicle Park Divisions, Section 10 Commercial/Industrial wi' eo UG~ 0 1481 Resolution No. 97 -94 Page: 2 Park Divisions, Section 11 Condominium Divisions; and Ordinance #09-0801-94, Zoning Code: Section 9 Planned Unit Developments, Section 18 Zoning Reclassification; and Section 6 Purpose of Districts-Table of Permitted Uses, except, single family residential uses. 2) That incomplete applications received prior to the date of this resolution, along with a full refund of any and all application fees, will be returned to the applicant and not processed; and 3) That applications which have been submitted and are substantially complete will be processed under the conditions which existed prior to this resolution; and 4) That Jefferson County will develop and adopt interim provisions within 45 days from the date of this resolution; and 5) That this moratorium shall remain in effect until such time that the interim provisions are adopted or 45 days from the effective date of this resolution, whichever is less.
