WHEREAS, William and Margaret A. Plommer, hereinafter LICENSEE,
holds Jefferson County License to Use Right of Way No. 1-12-90, permitting use
of a portion of the right of way of platted Hiller Drive; and
WHEREAS, LICENSEE'S interest in certain lots adjacent to the right of
way has been transferred by LICENSEE and he no longer holds title or lease to
said lots,
NOW THEREFORE BE IT RESOLVED, that as of this date William and
Margaret P10mmers' authorization, granted under Jefferson County License to
Use Right of Way No. 1-12-90, to use the portion of platted Hiller Drive and Oak
Bay Road southerly of an extended line thirty feet north of and parallel with the
south line of Lot 15 of Hiller's Waterfront Tracts, easterly of the centerline of said
Oak Bay Road, and westerly of the platted centerline of said Hiller Drive, is
terminated.

This agreement is between JEFFERSON COUNTY, acting by the Board of County
Commissioners, hereinafter referred to as the "COUNTY", and June D. Rubado,
hereinafter referred to as "RUBADO".
\^JHEREAS, RUBADO is the owner of Lot 16 of Hiller's \,tVaterfront Tracts, as
recorded in Volume 3, Page 31 of Plats, records of the Jefferson County Auditor, and
WHEREAS, RUBADO has a garden and parking area located upon the COUNTY
right of way of Hiller Drive, County Road No. 57430, and Oak Bay Road, County Road
No. 56990, in Section 7, Township 29 North, Range 1 East, W.M., more descriptively
shown as attached Exhibit "A" which by this reference is incorporated herein, and
WHEREAS, RUBADO acknowledges that the garden and parking area are on
COUNTY rights of way and recognize that the COUNTY requires protection of its interest
in the rights of way; NOW THEREFORE,
IT IS AGREED:
(1) LICENSE. RUBADO shall have a license to use, operate and maintain the
garden and parking area on that portion of the right of way of Hiller Drive, County Road
No. 57430, and Oak Bay Road, County Road No. 56990, southerly of an extended line
thirty (30) feet north of and parallel with the South line of Lot 15 of Hiller's Waterfront
Tracts as recorded in Vol. 3, Page 31 of Plats, easterly of the centerline of said Oak Bay
Road, and westerly of the platted centerline of said Hiller Drive, as shown on attached
Exhibit "A" for the purpose of a garden and parking area and for those purposes only.
Renewal of this license must be applied for within five (5) years of the date of Board of
County Commissioners approval. If the license is not renewed, expiration will be
automatic, and removal from the right of way of any and all appurtenances may be
required.
(2) COSTS AND EXPENSES. RUBADO shall pay all costs and expenses related
to the use, operation and maintenance of the garden and parking area.
(3) INDEMNIFICATION. RUBADO shall be responsible for the safe and proper
maintenance of the garden and parking area. RUBADO shall, further, defend and hold
the COUNTY harmless from all liability or expense of litigation in connection with any
item of actual or alleged injury or damage related to RUBADO'S use and maintenance
of the garden and parking area.
(4) TERMINATION. This license may be terminated by the COUNTY on ninety

(90) days notice. On termination, RUBADO will remove any and all appurtenances from
the right of way, and the right of way restored to a neat and orderly condition, subject to
the approval of the COUNTY. All costs incurred in restoring the right of way to a neat
and orderly condition shall be paid by RUBADO.
(5) TRANSFER OF LICENSE. This license shall not be transferrable by
RUBADO without the written consent of the COUNTY specifically referring to this
document.
(6) COUNTY APPROVAL FOR WORK TO BE PERFORMED. RUBADO shall
perform no work within COUNTY right of way without first having presented their plans
in writing to the Jefferson County Director of Public Works, and having received his
approval.
