The Statutory Vacation of Portions of x
Certain Platted Streets in the Plats of Quilcene x
The Supplemental Plat to Quilcene x
WHEREAS, the Jefferson County Board of Commissioners has reviewed a road vacation petition
submitted by Michael Shahda; and
WHEREAS, real property was dedicated to Jefferson County for road purposes in instruments dated
October 28, 1889 and March 14, 1890, and filed with the Jefferson County Auditor; and
WHEREAS, Jefferson County has not opened the following described roads for public use within five
(5) years of obtaining an interest in the real property for road purposes:
That portion of platted Dunning Avenue being 60 feet in width and 125 feet in length lying
between Lot 1, Block 14, and Lot 10, Block 11 of the Plat of Quilcene as recorded at Page 33 of
Volume 2 of Plats, records of Jefferson County, Washington; also that portion of Waite Avenue
being 60 feet in width and 575 feet in length lying northerly of the north margin of Chattanooga
Avenue in said plat; also that portion of Quilcene Avenue being 30 feet in width and 510 feet in
length adjoining Block 20 and extending to the extended East boundary of BLock 13 in said plat;
also Fremont Avenue being 75 feet in width and 450 feet in length adjoining Blocks 19 & 20 in said
plat; also Chattanooga Avenue being 100 feet in ,,:idth and 450 feet in length adjoining BLocks 16
& 19 in said plat.
That portion of Dagnen Avenue being 60 feet in width and 325 feet in length lying north of the
south margin of Fremont Avenue in the Supplemental Plat of Quilcene, as recorded at page 48,
Volume 2 of Plats, records of Jefferson County, Washington; also that portion of Fremont Avenue
being 75 feet in width and 405 feet in length adjoining Lots 12 through 20 in Block 21 and Lots
1 through 9 in Block 22 of said plat; also Quilcene Avenue being 30 feet in width and 195 feet in
length adjoining Lots 1 through 3 of Block 21 of said plat, and extending west to the west edge
of said plat; also Quilcene Avenue being 30 feet in width and 45 feet in length adjoining Lot 10 of
Block 21 of said plat.
WHEREAS, RCW 36.87.090 provides that any road unopened for public use for five (5) years after
the authority is granted for opening it shall be thereby vacated and the authority for building it barred
by lapse of time; and
WHEREAS, the above-described roads were vacated by operation of law and the County divested of
its interest before the 1909 amendment, Laws of 1909, Chapter 90, Section 1, which exempted from
vacation by operation of law certain lands dedicated for road purposes, became effective; and
WHEREAS, the Jefferson County Board of Commissioners desires to remove this cloud on title to
the real property;
NOW, THEREFORE BE IT RESOLVED that the dedicated platted roads more particularly described
above have been vacated by operation of law and Jefferson County asserts no claim of interest in them.
Utility rights, private easements, or other rights may still exist.
