RESOLUTION NO. 2--92

WHEREAS, the Jefferson County Board of Commissioners has reviewed a road
vacation petition submitted by Chaiyong Juntara; and
,
WHEREAS, the Jefferson County Hearing Examiner held a public hearing on the
road vacation petition on December 3, 1991; and
WHEREAS, the Jefferson County Hearing Examiner considered testimony of the
public, comments from applicable departments, agencies and offices, and recommendation
from the Jefferson County Public Works Department and Jefferson County Planning
Department at the public hearing; and
WHEREAS, the Jefferson County Hearing Examiner determined at the public
hearing that the public will benefit from the vacation of portions of the roads and such
vacation complies with the Jefferson County Comprehensive Plan and other applicable
plans, policies or ordinances; and
WHEREAS, the Jefferson County Board of Commissioners considered said Hearing
Examiner's report of the public hearing and his recommendation for the vacation request;
and
WHEREAS, the Jefferson County Board of Commissioners heard further testimony
at its regular meeting on January 6, 1992; that testimony indicated that the Hearing
Examiner's finding regarding potential for a trail was made without benefit of the testimony
of Mr. Acetola, who indicated that he has extensive trail-building experience and will
donate time and materials to build a trail on this right-of-way. With this addition, the
Board of County Commissioners hereby adopts the Findings of the Jefferson County
Hearing Examiner dated December 13, 1991; and
WHEREAS, compensation required pursuant to RCW 36.87.120, and Jefferson
County Road Vacation Ordinance No. 3-85 as amended by County Ordinance 04-0617-91
shall be paid prior to this vacation becoming effective;
NOW, THEREFORE BE IT RESOLVED that the following be vacated and
abandoned pursuant to RCW 36.87.140 and Jefferson Cöunty Road Vacation Ordinance No.
3-85 as amended by County Ordinance 04-0617-91: that portion of the unnamed street
being approximately thirty feet in width and 120 feet in length lying between Lot 11, Block
13 of the Second Addition to Trail's End Homesites, Inc., as recorded on Page 1, Volume
4 of Plats, records of the Jefferson County Auditor, State of Washington, and Lot 43, Block
3, of Trail's End Homesites, Inc, as recorded on Page 30, Volume 3 of Plats, records of the
Jefferson County Auditor, State of Washington. Said vacation is subject to the conditions

set forth in the Recommendation of the Hearing Examiner dates December 13, 1991,
adopted by reference herein. In addition, said vacation shall be subject to the following
condition: An easement shall be reserved or retained to allow the construction, repair,
and maintenance of a trail within the portion of the right-of-way to be vacated. Both
easements herein shall be recorded in the manner provided by law. Said trail shall be
constructed to conform with safety standards as provided by the Department of Public
Works.
