In the matter of
The Statutory Vacation of
A Portion of Platted Second Street
In the Plat of South Port Townsend

WHEREAS, the Jefferson County Board of Commissioners has reviewed a road
vacation petition submitted by James Clements; and
WHEREAS, real property was dedicated to Jefferson County for road purposes in
an instrument dated September 18, 1871, and filed with the Jefferson County Auditor at
Volume 1, Page 10 of Plats; and
WHEREAS, Jefferson County has not opened the following described road for
public use within five (5) years of obtaining an interest in the real property for road
purposes: .
That portion of platted Second Street, being 80 feet in width and 120 feet in
length, lying between Lot 8 of Block 7 and Lot 1 of Block 10 of the plat of
South Port Townsend, as recorded on Page 10, Volume 1 of Plats, records of
Jefferson County, Washington.
WHEREAS, RCW 36.87.090 provides that any road unopened for public use for five
(5) years after the authority is granted for opening it shall be thereby vacated and the
authority for building it barred by laps of time; and
/
WHEREAS, the above-described road was vacated by operation of law and the
County divested of its interest before the 1909 amendment, Laws of 1909, Chapter 90,
Section 1, which exempted from vacation by operation of law certain lands dedicated for
road purposes, became effective; and
WHEREAS, the Jefferson County Board of Commissioners desires to remove this
cloud on title to the real property;
NOW, THEREFORE BE IT RESOLVED that the county road more particularly
described above has been vacated by operation of law and Jefferson County asserts no
claim of interest in them. Utility rights, private easements, or other rights may still exist.

COUNTY OF JEFFERSON
To the Board of Jefferson County Commissioners:
The County Engineer of Jefferson County has examined the county right of way known
as Second Street lying between Lot 8 of Block 7 and Lot 1 of Block 10 of the Plat of
South Port Townsend and petitioned by James H. Clements to be vacated and
abandoned, and herewith submits the following report thereon:
This street was platted on September 18, 1871, in the plat of South Port
Townsend. There has never been a road constructed on this right of way, nor has
it been opened for public use, since it was platted; it is therefore vacated by
statute. It is recommended the Board of County Commissioners concur with
statutory vacation.

Regarding my petition for vacation of an area of a Jefferson County Road
which I signed and dated 06 July 19921
The Jefferson County Road is Platted Second Street. The area to be vacated
and a Quit-Claim Deed duly signed and recorded in my name is 80 feet in width and
120 feet in length, lying between Lot 6 of Blook 7 and Lot 1 of Block 10 of the
Plat of South Port Townsend, as recorded on Page 10, Volume 1 of Plats, records
of Jefferson County, Washington State.
I am the legal owner of the above Lot 6 of Blook 7 and Lot 1 of Block 10.
To the best of my knowledge there was never a road/street constructed and
opened for public use on this right of way(Platted Second Street) wi thin the
five(5) year window period since it was platted in September 1671, nor at any other
time up to the present dateo
