STATE OF WASHINGTON COUNTY OF JEFFERSON In the matter of x H/J'¡ [, 3¡t.BOGaY ';:-"¡::";:::',"" ;-nF"'!Ty~t,fì¡-¡r¡P' '-h..t.t.;,....v;;v\."""¡' !,,\\j;.¡, \.I.. 9r-Q.Ulu' -< ..BEPUH RESOLUTION NO. 69-92 The Statutory Vacation of x A Portion of "R" Avenue and of x "0" Avenue in the Plat of x Ingersoll's Addition x WHEREAS, the Jefferson County Board of Commissioners has reviewed a road vacation petition submitted by Gene Hubbard; and WHEREAS, real property was dedicated to Jefferson County for road purposes in an instrument dated May 5, 1889, and filed with the Jefferson County Auditor at Volume 2, Page 5 of Plats; and WHEREAS, Jefferson County has not opened the following described road for public use within five (5) years of obtaining an interest in the real property for road purposes: "R" Avenue adjoining Lots 7 & 8 of Block 1 of Ingersoll's Addition, as recorded in Volume 2, Page 5 of Plats, records of Jefferson County, Washington, and "0" Avenue adjoining Lots 1 & 2 of said block in said plat. WHEREAS, RCW 36.87.090 provides that any road unopened for public use for five (5) years after the authority is granted for opening it shall be thereby vacated and the authority for building it barred by laps of time; and WHEREAS, the above-described roads were vacated by operation of law and the County divested of its interest before the 1909 amendment, Laws of 1909, Chapter 90, Section 1, which exempted from vacation by operation of law certain lands dedicated for road purposes, became effective; and WHEREAS, the Jefferson County Board of Commissioners desires to remove this cloud on title to the real property; NOW, THEREFORE BE IT RESOLVED that the county roads more particularly described above have been vacated by operation of law and Jefferson County asserts no claim of interest in them. ""', SEAL: ",t,".s(}~ t')';"., AITEST: ,r- I JUt 2 8 19!rl vat 382 PA~, 34 vot. 18 ;~:.,:-oa 8:=;4, ENGINEER'S REPORT OF EXAMINATION STATE OF WASHINGTON COUNTY OF JEFFERSON In the matter of the petition of Gene Hubbard for the vacation of "R" Avenue and "0" Avenue in Ingersoll's Addition: To the Board of Jefferson County Commissioners The County Engineer of Jefferson County, has examined the county rights of way known as "0" Avenue adjoining Lots 1 and 2 of Block 1 of Ingersoll's Addition as recorded in Volume 2, Page 5 of Plats, records of Jefferson County, Washington, and "R" Avenue adjoining lots 7 and 8 of said block in said plat, and petitioned by Gene Hubbard to be vacated and abandoned, and herewith submits the following report thereon: This street was platted on May 9, 1889, in the plat of Ingersoll's Addition. There has never been a road constructed on this right of way, nor has it been opened for public use, since it was platted; it is therefore vacated by statute.
