HomeMy WebLinkAbout105 91 IN THE BOARD OF COUNTY COMMISSIOHERS IN AND POR THE COUNTY OF JEFFERSON IN THE MATTER OF a resolution declaring a three month moratorium on all development activity formerly regulated by the Jefferson County Development Code, No. 3-89, including industrial and commercial activities, multi-family developments, home businesses, signs, and temporary structures. ) ) ) ) RESOLUTION ) ) ) NO.1 05 ";91 WHEREAS, the Superior Court of the State of Washington for Clallam County has issued an order, No. 89-2-00646-7, declaring the Jefferson County Develop.ent Code, No. 3-89, Jefferson County's primary land use regulation, null, void, and without any effect whatever; and WHEREAS, the Court of Appeals for the State of Washington has denied Jefferson County's request for a stay of the aforementioned order No. 89-2-00646-7, pending appeal; and WHEREAS, the 1990 U.S. Census of Population and Housing, County and Place Profiles (Jefferson County), and the Washington State Office of Financial Management April 1 Populations of Cities, Towns, and Counties used for the Allocation of State Revenues State of Washington, indicate a growth rate of seven and twenty-two hundredths percent (7.22%) for Jefferson County for the year ending March 31, 1991, which is higher than any other county in the State of Washington; and WHEREAS, a projection of the seven and twenty-two hundredths percent (7.22%) growth rate for the year ending March 31, 1991 for the succeeding five years ending March 31,1996, indicates a total projected population increase of approximately nine thousand and eight (9,008) residents, for a total population of thirty thousand six hundred and eight (30,608) residents, as compared with twenty-one thousand six hundred (21,600) at the present date: and WHEREAS, this significant increase in the population of Jefferson County will likely result in a profusion of development activity in the unincorporated areas of the County; and 1 /GI- 1 7 r~(J: 00 1.2D~ WHEREAS, Jefferson County Planning and Building Department data relative to the number of certificates of compliance applied for under the Jefferson County Development Code, No. 3-89, from October 16, 1989 to the present date, indicates that an estimated three hundred and sixty two (362) certificates of compliance would likely have been applied for during the period from the present date through the end of the calendar year 1996; and WHEREAS, the hereinbefore projected new developments will involve industrial and commercial activities, multi-family developments, home businesses, signs, and temporary structures, which are unregulated following the aforementioned order of the Superior Court of the State of Washington for Clallam County; and WHEREAS, the Jefferson County Planning Department has accepted applications for specific proposed developments, for the following projects, which, prior to the issuance of the aforementioned order No. .89-2-00646-7 would have been regulated by the Jefferson County Development Code, No. 3-89: William and Patricia Goldfoos Gardiner Bicycle Hostel: Proposed change in use to permit an existing five thousand square foot structure to be used as a bicycle hostel pending certificate of compliance no. 8-91; George Forker - Rhody Drive Mini Storage: Proposed ten uni t mini storage facility encompassing approximately six thousand three hundred square feet - pending certificate of compliance no. 22- 91; Ruth McCurd - Remodelling and Expansion of Gardiner Store: Proposal to remodel existing two thousand six hundred sixty square foot structure and convert it into a gift shop with an adjacent realty office - pending certificate of compliance no. 24-91; Sam Boling - Heavy Bquip.ent Storage Site: Proposal to use a twenty acre parcel as a heavy equipment storage site - pending certificate of compliance no. 32-91; John Rodriguez - Automobile Repair\Home Business: Proposed automobile repair home business to be conducted in an existing barn - pending certificate of compliance no. 33-91; and Pope Resource., Inc. - Port Ludlow Inn: Proposed thirty six uni t hotel, two thousand five hundred square feet of retail \commercial space, fifty eight condominium units, thirty two shore front lots, and marina expansion - pending certificate of compliance no. 35-91; and WHEREAS, the Jefferson County Planning Department has engaged in preapplication consultations with prospective applicants for the following proposals, which, prior to the issuance of the aforementioned order No. 89-00646-7 would have been regulated by the Jefferson County Development Code, No. 3-89: 2 '10'- 17 rAc.-r 00 1.29:.; Dean Reynolds - Teal Lake Co_ercial Center: Proposed sixty acre commercial center at the intersection of Teal Lake Road and State Route #104, consisting of a mini-mart with gas station, hardware store, equipment rental shop, ministorage facilities, bank, overnight lodging facilities, restaurant, and recreational vehicle repair shop - preapplication consultation stage; Larry Milman - Port Hadlock Golf Course: Proposed eighteen hole golf course and residential housing development on Oak Bay Road opposite Skunk Island - preapplication consultation stage; Lakeside Industries - Rock Crushing and Asphalt Manufacturing Operation: Proposed rock crushing and asphalt manufacturing operation wi thin a residential neighborhood - preapplication consultation stage; General Construction Teaporary Graving Dock: Proposed temporary graving dock inside the existing Mats Mats quarry to construct pontoons for the new Mercer Island floating bridge, employing an average of one hundred and forty persons for two to three years, generating approximately one hundred forty round trip private auto trips, and three round trip truck trips per day - preapplication consultation stage; Theraionics Iforthwest, Inc. S..ll Industrial Testing and Manufacturing Operation: Proposed small industrial campus wi thin the Glen Cove Industrial Park, comprised of three buildings encompassing approximately twenty five thousand square feet of floor space, containing about ninety two parking spaces, and employing roughly forty five persons, dedicated to the testing and manufacture of precision instruments preapplication consultation stage; Clarence Braahall - Airplane Hangar: Proposed eleven thousand five hundred square foot airplane hangar on land leased from the Port of Port Townsend at the Jefferson County International Airport - preapplication consultation stage; Clarence Braahall - Beyview Avenue Ministorage: Proposed forty five unit ministorage development on Bayview Avenue between Otto Street and Clementine Street, comprised of two buildings totalling six thousand square feet - preapplication consultation stage; Pope Resources, Inc. Port Ludlow Golf Course Addition: Proposed nine hole addition to the Port Ludlow golf course encompassing approximately sixty acres south of Paradise Bay Road across from the Inner Harbor, and west of the existing eighteen hole Port Ludlow golf course; approximately seventy eight thousand six hundred square feet would be covered with an impervious golf cart path - preapplication consultation stage; Mike Cavett - Hastings Avenue Winery: Proposal to convert an existing three thousand square foot barn at the intersection of Hastings Avenue and Cook Avenue into a retail winery located in an area designated as suburban by the Jefferson County Coaprehensive Plan; and 3 1'0'- 1 7 i!.~r on j2~t~ WHEREAS, the aforementioned actual and proposed developments are representative of the type and scale of development activity that will likely continue in the absence of the Jefferson County Developaent Code, No. 3-89; and WHEREAS, the aforementioned actual or proposed developments may be destructive of the County's planning options in that construction activities might progress so far as to defeat in whole or in part the ultimate execution of the Jefferson County Coaprehensive Plan; and WHEREAS, unregulated development of this nature runs counter to the purposes, goals, policies, and objectives of the Jefferson County Coaprehensive Plan, and could result in disorderly, incompatible and unpredictable development; and WHEREAS, such unregulated development is contrary to the County's responsibility to classify, designate and regulate "resource lands" and "critical areas" pursuant to the Washington State Growth Manageaent Act (Chapter 17, Laws of 1990, 51st Legislature, Extraordinary Session); and WHEREAS, such unregulated development would not be in the best interests of the health, safety, and welfare of the citizens of Jefferson County; and WHEREAS, Jefferson County is currently in the process of developing an interim zoning ordinance which will regulate industrial and commercial activities, multi-family developments, home businesses, signs, temporary structures, and grandfathered uses which will not be devised or enacted into law for approximately three months; and WHEREAS, industrial and commercial activities, multi-family developments, home businesses, signs, and temporary structures, should not be sanctioned by Jefferson County during the pendency of the development of said interim zoning ordinance; and WHEREAS, the Jefferson County Board of Commissioners finds that the facts cited above evidence that an emergency exists in Jefferson County; NOW, THEREFORE, BE IT RESOLVED, that a moratorium on all development activity heretofore regulated by the 3efferson County Developaent Code, No. 3-89, now exists, and shall remain in effect for three months or until an interim control can be developed, whichever period is shorter, following the effective date of this resolution. 4 VOl. 1 7 rM-' on t2DG ADOPTED THIS 1~ DAY OF NOVEMBER, 1991. .// . . ~ . ,,' ..-."
