RESOLUTION NO. 21-90
A RESOLUT ION AUTHOR I ZING THE JEFFERSON COUNTY TREASURER TO
BEGIN FORECLOSURE PROCEEDINGS PURSUANT TO RCW 36.88.140
WHEREAS, the Jefferson County Board of Commissioners,
by Resolutions 61-81 and 70-81, established Road Improvement
Districts 1 and 2 pursuant to the provisions of RCW 36.88 et
seq; and
WHEREAS, said Districts have levied assessments against
the lots, tracts and parcels within said District for road
improvements therein; and
WHEREAS, it has corne the the attention of the
Commissioners of said Districts that there are assessments within
said Districts which are deliquent and should be foreclosed by
lien; now therefore
IT IS HEREBY ORDERED, by the Board of County
Commissioners, serving in their capacity as the Commissioners of
RID 1 and RID 2, that the Jefferson County Treasurer shall
proceed wi th foreclosure proceedings as set forth in RCW
36.88.140.

RE:
RID FORECLOSURES
RCW 36.88.140 states that the time of payment, interest rate and
delinquent interest shall all be set forth by resolution. I have
not had an opportunity to review Resolutions 61-81 and 70-81 to
ascertain whether or not those items are covered.
In reviewing the statute I note that foreclosure proceedings
should be commenced prior to March 1. It appears that we will
not be able to comply wi th the statutory requirements for
foreclosure in a timely fashion this year, thus there will be
time to review the resolutions and amend them if necessary.

RE: Road Improvement District #1 delinquent assessments
Road Improvement District #2 delinquent assessments
Dear Commissioners:
As Treasurer of Jefferson County, I wish to begin foreclosure
proceedings on delinquent assessments in your taxing district.
To do so will require your Board of Commissioners to furnish a
resolution or ordiance authorizing me to proceed. I suggest that
your legal counsel assist you in drafting the document. If you
wish to be a part of this action, you must have the resolution in
my office prior to February 15th. Failure to do so will leave your
district out of the foreclosure action for the 1990 year. ,)t ~~

In the past each district has proceeded on their own. It has been
brought to my attention that under R. C. W. 35.50.030 and R. C. W
54.16.130, it is part of my duties. To cut expenses and save time
I am choosing to do all the assessments and all districts at the
same time.
